A Kanpur court has denied builder Haji Mohd Wasi’s request for anticipatory release after he was charged with sponsoring the riots on June 3.
A court in Kanpur denied builder Haji Mohd Wasi’s application for anticipatory release. Wasi is suspected of providing funding to Hayat Zafar Hashmi, head of the MMA Johar Fans Association, who organised the riots on June 3 in Kanpur.
He was the subject of three police complaints, and in each of those incidents, he filed an anticipatory bail application. Wasi had applied for anticipatory bail in order to avoid being arrested. In order to delay the application’s decision, interim bail was requested; however, Additional District Judge Jitendra Kumar Dwivedi declined to grant interim bail.
The police had been asked to submit a report regarding the anticipatory bail application to the court. The article stated that the Colonelganj Police had previously been conducting the probe, but that the SIT has now been reorganised and the focus has been moved to Kotwali.
The SIT team requested 10 days to submit the report because the case diary and related papers had not yet been transferred.
Wasi’s attorney stated that the police are attempting to detain Wasi by accusing him in three instances. If the arrest is made, then the anticipatory bail application will be of no importance. Wasi should therefore be given provisional bail until the next hearing.
The court considered the interim bail to be unwarranted after hearing from both parties, and set July 5 for the hearing on the anticipatory bail applications in all three cases.
Another 40 or more suspects have also requested bail. On Thursday, there were some applications to be heard. But the hearing will take place on July 6 instead because the police report is not yet available.
On Friday, a hearing for 10 to 15 bail requests will also take place concurrently.
