Kerala Woman Behind Bars For Allowing Partner Sexually Assault Her Minor Daughter

: Fast Track Court in Kerala has handed a 40-year prison sentence and imposed a ₹20,000 fine on a woman under the Protection of Children from Sexual Offences Act (POCSO).

The case, spanning from March 2018 to September 2019, involved the accused, who had separated from her mentally ill husband, residing with her partner, Shishupalan. During this period, Shishupalan subjected the child to severe abuse, resulting in injuries to the child’s private parts. The mother, aware of the abuse, brought the child to Shishupalan’s house, where the assaults occurred.

The victim, upon the arrival of her eleven-year-old sister, disclosed the abuse, revealing that both children were threatened into silence. The elder sister eventually fled with the younger child to their grandmother’s house, where the incident was revealed, leading to the relocation of the children to a children’s home.

During the initial abuse, when the girl was seven years old and in the first standard, the first lover, Shishupalan, subjected her to brutal treatment. That time the victim has told the entire incident to the accused but she did not do anything and she helped the other lover to abuse the victim.  Judge R Rekha determined that the accused, acting in such a manner, is a disgrace to motherhood and does not warrant any sympathy. Consequently, the maximum sentence was deemed appropriate for her actions.
