“Let the status quo be maintained. No faction should be hurt, the status quo should be understood,”Kapil Sibal,who is appearing for team Thackeray said.

Mumbai: The Supreme court, on Wednesday, while hearing pleas relating to the Sena Vs Sena battle over revolt in the party, said that the issues involved in the petitions need to be referred to a larger bench for consideration. However, the court will make a decision on the matter during the next hearing, which is expected to be on August 1.

The bench which is led by CJI NV Ramanna, asked Team Thackeray and the Shinde group to frame issues they wanted to argue, make a compilation and submit it preferably by next week. It also directed the respondents to file a common affidavit if they wished to deny any allegations. Disqualification proceedings, the election of the speaker of the house, recognition of the whip, and the vote of confidence are among other issues that are the subject matter of the dispute.

Advocate Harish Salve who is appearing for Mr Shinde said, “If a large number of people in a party feel that another man should lead, what is wrong in that? The moment you gather enough strength within the party and stay within the party to question the leader without leaving the party, and say we will defeat you in the house, that is not defection”.

On the issue of removing of legislature party leader the apex court said “Removal of the leader of legislature party is in the domain of party MLAs. In case of dispute or doubt, the Speaker has to decide”. But senior advocate Abhishek Singhvi who represents team Thackeray pointed out that the rebel MLAs did not attend the common meeting for which a whip was given where they could have elected a new legislative leader.”

On Tuesday the Thackeray group suffered a fresh jolt with 12 of its 19 Lok Sabha members joining with the Shinde camp and declaring two-twem member Rahul Shewale as their leader in the Lok Sabha.
