Prayagraj: The Allahabad High Court on Thursday will resume hearing the petition filed by Parveen Fatima, spouse of Prayagraj violence accused Javed Mohammad, challenging the demolition of her house.

The Uttar Pradesh government will file a counter-affidavit in the high court today. The Allahabad High Court on Tuesday had sought a reply from the state government within 24 hours on the petition filed by Javed Mohammad’s wife.

Javed Mohammad was arrested on June 10 on charges of instigating violent protests against certain remarks made by former Bhartiya Janata Party spokesperson Nupur Sharma on Prophet Muhammad during a live news debate. The Prayagraj Development Authority (PDA) then demolished Javed’s house on June 12, claiming that the building map of the house had not been approved by them.

A division bench of Justice Anjani Kumar Mishra and Justice Syed Wiz Mian will be hearing the matter on Thursday.

In the petition, Parveen Fatima and her daughter Sumaiya Fatma said that the former was the owner of the house that she had received as a gift from her parents before her marriage.

The petitioners claimed that the notice by the PDA was not addressed to Parveen Fatima but her husband Javed Mohammad and that her house was arbitrarily demolished.

In the petition, Fatima demanded the re-construction of her house and action against the guilty officers. Fatima, in her petition, further demanded that government accommodation be provided to them till the new house is built and appropriate compensation was provided.

In the petition, the UP government, Commissioner of Prayagraj Division, District Magistrate and Senior Superintendent of Police of the district, and Prayagraj Development Authority have been made parties.
