New Delhi Sep 29 PTI The Delhi High Court Wednesday sought a response from Delhi Police on a bail application of an accused arrested in a case concerningalleged communal sloganeering at an event at Jantar Mantar last monthJustice Mukta Gupta issued notice to the police on the bail plea by Sushil Kumar and sought a status reportThe judge posted the matter for the next hearing on October 26The accused who is the chief of an organisation called Hindu Army was arrested from Lucknow Uttar Pradesh on August 20 and is in judicial custody since thenOn September 23 a trial court here had dismissed his bail application saying that the investigation was at a crucial juncture and there was a strong possibility of him interfering in the investigation of the case andor influencing and threatening the witnessesAdditional sessions judge Anil Antil had stated that the video clip and transcript on record were explicitly infested with communal overtures having the tendency to incite communal hatred disharmony and ill-will between other section of the community and the accused has not even specifically disputed his identity in the alleged clip The allegations are serious in nature the offence alleged is also no less severe than the nature of the accusations the trial court had statedDelhi police had opposed the bail plea of Sushil Kumar on the ground that the video clips clearly showed that he was delivering the allegedly inflammatory speech at the event held on August 8 It was claimed that the objectionable slogans and hatredinflammatory speeches were delivered by the applicantaccused against a particular community as part of a well-hatched conspiracy The accused had contended before the trial court that the video of the alleged incident was an edited record that was prepared to intentionally and deliberately book himPTI ADS RKS RKS

New Delhi Aug 24 PTI A Delhi court has dismissed the anticipatory bail application of a Hindu organisations president who allegedly raised communal slogans saying we are not a Taliban State Additional Sessions Judge Anil Antil dismissed the application of Bhupinder Tomar president of Hindu Raksha Dal and said that in the past such incidents have flared communal tensions leading to riots and loss to life and property Tomar was accused of raising communal slogans and inciting the youth to propagate against a particular religion at a rally at Jantar Mantar on August 8 We are not Taliban State Rule of law is the sacrosanct governing principle in our plural and multi cultural society While the whole of India is celebrating azadi ka amrut mahotsav there are some minds still chained with Intolerant and self centric beliefs the judge said in the order passed on August 21 The court said complicity of the accused in the case was prima facie apparent from the available evidence and the accusations against him were serious and severe in nature History is not immune where such incidents have fared communal tensions leading to riots and causing loss to life and property of general public the court order said The police had imposed the pre-arrest bail application alleging that the accused used the platform at Jantar Mantar to create communal disharmony and to give communal colour to their plans incited the youth to propagate against a particular religion despite the sanction to gather refused by the competent authority During the court proceedings the judge had also played a video clip of an interview of the accused to a YouTube channel and observed that it was impregnated with high octane communal barbs laced with inflammatory insulting and threatening gestures He had said the interview was indicative of the calculative design on the part of the accused to promote hatred and ill will amongst other sections of the community He said that even though the right to freedom of speech was a fundamental right one of the most cherished natural right enshrined in the Constitution under Article 191a but it was not an unfettered right It is not absolute Nor can it be extended to transgress upon fundamental right of other people nor can it be expanded to the acts pre-judicial to maintenance of peace harmony and public order nor can it be permitted to invade and erode the secular fabric of our society he said He added that in the garb of libertarian concept of free speech the accused could not be allowed to trample the Constitutional principles which promote inclusiveness and common brotherhood During the arguments the prosecution had opposed the application saying that the investigation was at nascent stage and since the accused was President of Hindu Raksha Dal if released on bail at this stage he will hamper the investigation and threaten witnesses considering his tone and tenure of his speech and the threatening words used in the alleged interview The accused had sought pre-arrest bail on the ground that he had not been convicted earlier and that there was no chance of him fleeing from justice He also undertook to join the investigation as and when required if granted the relief PTI UK SA

New Delhi Stating that India is not a Taliban state and rule of law is the sacrosanct governing principle in our plural and multicultural society a Delhi court has now denied pre-arrest bail to Hindu Raksha Dal chief Pinky Chaudhary in connection with the Jantar Mantar protest where inflammatory speeches were given out by protesters who were agitating in favour of taking down colonial-era lawsIn his order Additional Sessions Judge Anil Antil said that while the whole of India is celebrating Azadi ka Amrut Mahotsav there are some minds still chained with intolerant and self-centric beliefsThe court added that the complicity of the applicantaccused in the alleged case crime is prima facie apparent from the material placed before the courtThe judge also said that the entire incriminating material was yet to be seized and that other persons involved in the incident are absconding and evading the lawReferring to the video of the speeches made at Jantar Mantar the court stated that it was evident from the video played during the proceedings that the said clip depicting the interview of the applicant is impregnated with high octane communal barbslaced with inflammatory insulting and threatening gestures ex-facie is indicative of the calculative design on the part of the applicant to promote hatred and ill will amongst other sections of the community
