New Delhi Jan 27 PTI The Delhi High Court Thursday asked the prison authorities here to provide adequate security in judicial custody to the co-accused of undertrial Ankit Gujjar who was found dead inside the jail premises last year Justice Anu Malhotra also asked Delhi Police to provide adequate security to the wife of the petitioner co-accused and directed that subject to the orders of the Chief Justice their petition which sought directions to restrain the jail officials from threatening coercing injuringextorting them be placed on March 4 before the judge dealing with the case concerning the custodial death of Gujjar Lawyer Mehmood Pracha appearing for the petitioners alleged that the petitioner-inmate is facing extortion at the hands of certain jail officials who are threatening him with a similar fate as Ankit Gujjar Gujjar 29 was found dead inside his cell in Tihar jail on August 4 last year The lawyer also submitted that the petitioners are being harassed to influence the Gujjars family to withdraw their complaint related to his death and extortion of money Counsel for the state said that there were no objections against granting adequate protection to the petitioners Counsel for the CBI said that investigation into Gujjars death and allegations of extortion were going on Gujjars family had moved the high court last year alleging that he was harassed by the jail officials as he was unable to meet their regularly increasing demands for money and was murdered as a part of a pre-planned conspiracy While transferring the probe into the death to the CBI Justice Mukta Gupta had opined that the deceased had lost his life to custodial violence Subsequently a petition was moved by the co-inmates of the deceased who were also victims of the same assault seeking protection and security The prison authority had then said that directions were in place to ensure the safety and security of witness inmates and they are being lodged in an area under CCTV surveillance PTI ADS SA

New Delhi Dec 24 PTI The Delhi High Court on Friday refused to direct the ED to record in Kerala statements of Popular Front of India PFI members in a money laundering case saying a court cannot dictate the mode and manner of an investigationHearing a plea against summons issued to three PFI members to appear before the ED in Delhi Justice Anu Malhotra said if there were any restrictions on the persons travelling to the national capital on account of the pandemic the central agency would conduct the interrogation at its zonal office in KeralaCourt cannot direct manner and mode of investigation That is not the job of the court At the moment there is no restriction on travel the court saidIn the event of there being any travel restrictions from Kerala to Delhi the respondent ED is directed to conduct interrogation in Kerala at the zonal office it orderedThe court also refused to direct the ED to place before it the reasons pursuant to which a search operation was carried out in the case earlier this month in KeralaCurrently the same seeking reasons is not considered appropriate as there is no stay on the investigation the court stated as it noted that the PFIs petition challenging the case as well as the application seeking a stay on the investigation was pending adjudicationOn December 8 the court had sought the EDs response on the PFIs plea challenging a money laundering case registered by the agency in 2018 following an NIA case concerning the alleged training of youngsters in Kerala for carrying out anti-national activitiesLawyer Amit Mahajan appearing for the ED argued that the summoned members cannot direct the agency as to how the investigation is to be conductedHe added that whenever a person expresses a genuine difficulty in coming to the national capital for interrogation and the same does not hamper the investigation such concerns are considered by the agencyLawyer Adit Pujari representing the PFI stated that search operations were conducted by the agency earlier this month in Kerala and summons were issued to three members to appear in DelhiHe sought a direction to the central agency to conduct the interrogation at its Kerala zonal office on account of concerns surrounding the spread of COVID-19 as well as the fact that the members were not residents of Delhi or well-versed with the local languageThe lawyer had earlier submitted before the court that over 150 summons were received by several of its members from across the country for a roving and fishing inquiry in the case by the EDThe matter will be heard next in February PTI ADS IJT

New Delhi Nov 26 PTI The Delhi High Court Friday stayed a trial court order directing action against two Delhi police officials for filing distinct charge sheets in a POCSO caseJustice Anu Malhotra issued notice on the petition by the two officials -- station head officer SHO of the police station concerned and investigating officer IO-- and sought a status report from the stateThe matter is directed to be re-notified on December 9 till which the operation of the order dated November 24 2021 is stayed the judge statedOn November 24 the trial court directed appropriate legal action against the two officials for prima facie commission of offences related to public servants false evidence and other offences under the Indian Penal Code saying that fraud has been played on the court after it was found that there were two charge sheets in the caseThe petitioners argued that the trial court could not have passed the directions or passed unwanted and castigating remarks while deciding a bail application in the caseSince a trial court has no inherent power to pass blanket directions as it is not akin to the constitutional courts the order directing initiation of action was passed erroneously it statedThe petition claimed that the existence of two charge sheets was a genuine mistake but the trial court considered it as fraud and perjuryThe confusion of the charge sheet and amended charge sheet led to a situation wherein the Court file had the amended charge sheet the accused also had the amended charge sheet the Public prosecutor had both the charge sheet and the amended charge sheet in the police file and the Complainant had the charge sheet It is submitted the Petitioners conducted a fair investigation and there was no malafide on the part of the Petitioners the petition saidIt also argued that the trial court encroached upon the administrative functions of the police administration as it passed the order under challenge despite an inquiry finding that the existence of two charge sheets was without any malafide intentionBefore directing initiation of action under the criminal law the trial court on November 8 had said that the conduct of the police officials was perfidious reprehensible and amounted to interference with the justice dispensation processIn its order passed on November 24Additional Sessions Judge Gaurav Raohad said that the police investigation was a sham and no explanation was provided as to how two charge sheets having distinct facts were signed on the same dayThe FIR is the case alleged that in February the accused took the prosecutrix a minor to some house in JJ Colony and kept her there for 6 days and committed rape upon her PTI ADS RKS RKS
