New Delhi Jan 28 PTI BJP president J P Nadda on Friday welcomed the Supreme Court order that held the Maharashtra assembly decision to suspend 12 BJP MLAs from the House for one year as unconstitutional and irrational The courts verdict to reject this decision which was in violation of democracy and the constitution is a victory of truth Nadda said adding that the BJP will continue to raise its voice against Maharashtras Maha Vikas Aghadi government The BJP will always battle for peoples rights in line with the Indian Constitution and democracy he said The apex court delivered its verdict on the pleas filed by the 12 BJP MLAs who had challenged their one-year suspension from the state assembly for allegedly misbehaving with the presiding officer They were suspended for one year on July 5 last year from the Maharashtra Assembly after the state government had accused them of misbehaving with presiding officer Bhaskar Jadhav in the Speakers chamber PTI KR RCJ RCJ

New Delhi Jan 19 PTI The Supreme Court Wednesday reserved order on the pleas filed by 12 BJP MLAs who challenged their one-year suspension from Maharashtra Legislative Assembly for allegedly misbehaving with the presiding officer A three-judge bench headed by Justice A M Khanwilkar asked the parties to file their written submissions within a week At the outset senior advocate Mahesh Jethmalani appearing for one of the MLAs submitted that prolonged suspension is worse than expulsion as the rights of the constituents are affected Senior advocate Mukul Rohatgi appearing for the other MLAs said the decision for one year suspension was grossly irrational The apex court had on Tuesday said suspension from Legislative Assembly for one year should be linked with some purpose and there has to be an overpowering reason that the member should not be allowed to even attend the next session The 12 BJP MLAs have filed petitions challenging the resolution passed by the Assembly to suspend them for one year They were suspended on July 5 last year from the Assembly after the state government had accused them of misbehaving with presiding officer Bhaskar Jadhav in the Speakers chamber The 12 suspended members are Sanjay Kute Ashish Shelar Abhimanyu Pawar Girish Mahajan Atul Bhatkhalkar Parag Alavani Harish Pimpale Yogesh Sagar Jay Kumar Rawat Narayan Kuche Ram Satpute and Bunty Bhangdia The motion to suspend these MLAs was moved by state Parliamentary Affairs Minister Anil Parab and passed by a voice vote PTI PKS SA

Mumbai Dec 24 PTI Deputy Speaker of the Maharashtra Legislative Assembly Narhari Zirwal on Friday asked the legislature secretary not to respond to the Supreme Courts notice on the plea filed by 12 BJP MLAs challenging their one-year suspension The 12 legislators were suspended on July 5 this year after they allegedly misbehaved with presiding officer Bhaskar Jadhav in the Speakers chamber Zirwal directed the government to apprise the apex court of the developments that led to the suspension of these BJP members BJP leader Sudhir Mungantiwar wondered how the government can hold speakers election by keeping 12 voters suspended Leader of Opposition Devendra Fadnavis said the 12 legislators have applied to the speakers office requesting their suspension be reconsidered I hope their suspension is revoked before the speakers election next week he said Zirwal said that the SC notice was received by the legislature secretariat on December 21 The 12 suspended members are Sanjay Kute Ashish Shelar Abhimanyu Pawar Girish Mahajan Atul Bhatkhalkar Parag Alavani Harish Pimpale Yogesh Sagar Jay Kumar Rawal Narayan Kuche Ram Satpute and Bunty Bhangdia On December 14 the Supreme Court had sought responses from the Maharashtra legislative assembly and the state government on the pleas filed by these MLAs who have challenged their one-year suspension The apex court had observed that the issues raised in the matter and arguments advanced by the advocates appearing for the petitioners as well as the state are debatable and require deeper consideration PTI MR NP NP
