New Delhi Dec 17 PTI It is for the authorities to decide on construction of a dam the Supreme Court said on Friday and asked the petitioner who had raised issues related to the proposed construction of a reservoir at Mekedatu to send a reminder to them for considering his representation expeditiouslyA bench of Justices A M Khanwilkar and C T Ravikumar asked the petitioner whether he has made any representation to the government on the issueThe petitioner told the bench that he had sent representations to the Centre as well as the states of Tamil Nadu and Karnataka but he has not received any responseThe petitioner has made representation to different authorities with regard to the subject matter of this writ petition as back as in January 2021 It will be open to the petitioner to send reminder to the concerned authorities for considering that representation expeditiously the bench saidOn receipt of such request the concerned authorities ought to respond to the petitioner about the outcome of the representation one way or the other preferably within three months therefrom the bench said in its order while disposing of the pleaEarlier the Tamil Nadu government had moved the apex court seeking to restrain Karnataka from proceeding with any activity regarding the proposed construction of a reservoir at Mekedatu across the inter-state Cauvery riverDuring the hearing on Friday the bench observed that it is not for the court to decide where a dam should be constructedThe authorities will decide this It is not our job First they have to take a decision If that decision is illegal then we will step in not otherwise the bench saidThe petitioner had filed two separate pleas on the issue in the top courtIn one of the pleas he had said that the proposed construction of dam at Mekedatu would destroy the already battered Cauvery river and change the climate as well as the forest area thereThe petition said the Cauvery Wildlife Sanctuary hosts unique and endangered wildlife species and their habitats must not be disturbed by any kind of constructionsIn its plea filed earlier in the top court the Tamil Nadu government had stated that the planning of the Mekedatu project by Karnataka with a capacity of 6716 TMC ft and generation of 400 MW power at a cost of about Rs 9000 crore is in gross violation of the decision of Cauvery Water Disputes Tribunal PTI ABA SRY
