Bengaluru Feb 26 PTI Amid the raging Hijab controversy in Karnataka Vice President Venkaiah Naidu on Saturday said unnecessary controversies should not be encouraged and students should be guided by the school uniform Unnecessary controversies should not be encouraged like the controversy going on in Karnataka In a school you are all guided by the school uniform whatever uniform it is Naidu said after inaugurating the indoor sports arena and Latelier at a private school in Bengaluru Underlining the need to realise the beauty of diverse Indian culture the Vice President said Vividhata mein Ekta Bharat Ki Visheshta Unity in Diversity thats Indias specialty Alag Bhasha Alag Vesh - Phir Bhi Apna Ek Desh Different languages different constumes -- Yet we are one nation He also said that people should remember that they are Indians first Irrespective of caste creed sex religion and region we all are one We are Indians first This should be remembered by one and all There should not be any discrimination the vice president pointed out Naidu also pointed out that people should feel proud of the languages they speak and promote them Stressing on extra-curricular activities in the schools he said the new National Education Policy insists on this aspect He also urged all the state governments and educational institutions to give priority to sports extra-curricular activities and also developing spiritual minds among children Spirituality does not mean religion Religion is your personal choice but our culture our heritage our Dharma duty we should all follow in our lives the Vice President told the audience According to Naidu the erosion of values has been causing havoc in the world for humanity We must restore values preserve our heritage promote our culture and feel proud to be an Indian Be proud that you are a Bharatiya the Vice President said Stating that once upon a time India was known as a Vishwa Guru Naidu pointed out that prolonged colonial rule has made us forget our glorious past India is on the move today and it is time to go back to our roots he added In his inimitable style Naidu told the gathering that discipline dynamism education dedication devotion were need of the hour in India Education is a mission not for commission There should not be any omission We should not give any remission and work for the promotion of the nation with a passion This is what is required he said The Vice President also urged educational institutions to give equal importance to studies sports co-curricular and recreational activities He said such an approach will lead to the all-round growth of students and make them confident individuals He also wanted the educational institutions to involve students in activities such as gardening tree plantation and water conservation This will bring children closer to nature he said and further highlighted the need for water conservation by stressing on 3Rs- Reduce Reuse and Recycle Highlighting the importance of physical fitness in the daily activities Naidu wanted the Fit India movement reach every school college university panchayat and village Describing art as limitless the Vice President said that art gives form to our imagination and speaks a universal language that has no boundaries Referring to Indias unique and diverse dance forms he mentioned Bharatnatyam Kuchipudi Kathakali and Kuchipudi as some of the many ancient art forms that have been passed on from generation to generation Indias art music and drama are its greatest gifts to the world and it is the duty of each one of us to protect and promote our rich and diverse art forms the vice president said Karnataka Governor Thaawar Chand Gehlot Karnataka Minister Munirathna and school authorities were also present on the occasion On January 1 six girl students of a college in Udupi attended a press conference held by the CFI in the coastal town protesting against the college authorities denying them entry into classrooms wearing hijab This was four days after they requested the principal permission to wear hijab in classes which was not allowed Till then students used to wear the headscarf to the campus but entered the classroom after removing it college principal Rudre Gowda had said The institution did not have any rule on hijab-wearing since no one used to wear it to the classroom in the last 35 years The students who came with the demand had the backing of outside forces Gowda had said As the issue of Hijab versus saffron scarves spread to several educational institutions in many parts of Karnataka the state government announced holiday from February 9 to February 15 in all the pre-university college and from February 9 to February 16 in degree and diploma colleges The girls then approached the Karnataka High Court seeking relief and quashing the government order on February 5 restraining students from wearing any cloth that could disturb peace harmony and public order The full bench of the High Court comprising CJ Awasthi Justice J M Khazi and Justice Krishna S Dixit which has been hearing the case on a day-to-day basis since February 10 in its interim order asked the state government to reopen the educational institutions which were hit by the agitation and restrained students from wearing Hijab and saffron scarves in the class-room till the final order is delivered The court has completed its hearing and is likely to pass its final order shortly PTI GMS GMS SS SS

Bengaluru Feb 25 PTI The Karnataka High Court on Friday said it has called for a report from the state government on the role of radical organisations behind the Hijab controversy in the state The court was hearing a petition filed by Ghanshyam Upadhyay who sought an investigation by the Central Bureau of Investigation CBI and the National Investigation Agency NIA into the row that started from the coastal district headquarters town of Udupi and spread to different parts of Karnataka last month We have already called for a report from the government and we will consider your submission Chief Justice Ritu Raj Awasthi told senior advocate Subhash Jha from Mumbai who represented Upadhyay The full bench of the High Court comprising CJ Awasthi Justice J M Khazi and Justice Krishna S Dixit has been hearing the case on a day-to-day basis since February 10 Presenting his argument before the bench Jha said the agitation pushing for wearing of Hijabs in class-rooms was the handiwork of radical organisations which are funded by some foreign nations An agitation of this magnitude cannot be created overnight and therefore if this agitation is engineered and this is obviously engineered funded by some organisation this cannot start out of the blue This is the sinister design Jha told the bench The Chief Justice sought to know whether he has presented any material to show that there is some organisation and people behind this agitation To this Jha said when the court was hearing the batch of petitions Harsha a Bajrang Dal activist was killed in Shivamogga and a radical organisations name has surfaced In reply CJ Awasthi said it was not proper to draw any conclusion when the investigation was pending and the police were doing their work Unless police comes out with something related to this case saying that it was this organisation which is linked to the killing of that person we cannot draw presumptions the Chief Justice said The counsel said receipt of information and not the credible information is sufficient to start an investigation All these abundant circumstances sufficiently indicate that there is something much more than what meets the naked eyes the lawyer argued Asking Jha to refrain from drawing presumption the Chief Justice said the authorities have been taking appropriate action wherever there is a problem We cannot draw presumption that the case requires to be handed over to the CBI or NIA for investigation Justice Awasthi said Jha urged the court to consider calling upon Union Home Ministry which is a party Let there be a report by the Home Ministry to tell the court that there is some sinister design like this Jha contended Highlighting that the such petitions are being filed at a regular intervals in various courts he wondered how many hours of judicial time were spent on these issues In his rejoinder argument senior counsel Professor Ravi Varma Kumar representing the petitioner Muslim girls arguing against the governments hijab ban said the College Development Committee headed by the MLAs of the government colleges in their respective constituencies and their nominee members cannot be vested with administrative powers Citing a case he said out of 12 members in the CDC 11 are the nominees of the MLAs An absolute power has been given to the MLAs The college has been handed over to the MLA on the platter Kumar contended He also pointed out that the elected representatives have the recommendatory role and not the administrative role There is no accountability of the MLA who sits like a monarch in the college Supposing there is financial irregularity and the committee is found involved in it who will investigate them Kumar said Senior advocate Yusuf Muchchala quoting verses from the Quran argued that the tradition of Islam enjoins covering head and neck The Karnataka high Court has been hearing the matter related to Hijab since February eight For first two days the single judge bench of Justice Krishna S Dixit was hearing the matter However on February 9 he referred the matter to the Chief Justice saying a larger bench could hear the matter Accordingly CJ Awasthi formed the three-judge full bench and heard on a day-to-day basis in the last two weeks a batch of petitions filed by some Muslim girls seeking permission to wear Hijab in educational institutions where a uniform has been prescribed The girls were Bengaluru Feb 24 PTI The Karnataka High Court on Thursday asked the counsels in the Hijab case to wind up their arguments by Friday as it indicated that it will shortly deliver the order The Chief Justice of the High Court Ritu Raj Awasthi who is part of the three-judge bench told the counsels that that the arguments should be finished by Friday He also asked the parties to give their written submissions within two to three days Meanwhile in his rejoinder argument advocate Devadatt Kamat said his client studies in a co-education college where she got admitted two years ago According to him she was in the habit of wearing Hijab from the time she joined the college but suddenly the restriction was imposed and she was forced not to wear it anymore Kamat told the court that he is not asking for any general declaration on Hijab that it is part of an essential religious practice but his contention was the government order on Febuary 5 which barred everyone from wearing clothes that could disturb peace harmony and public order According to him the GO cannot stand and it has to be quashed If the GO goes there is no restriction on the exercise of a fundamental right under Article 25 the lawyer argued In reply the Chief Justice sought to know how can he insist on wearing hijab in an institution which has a uniform and which fundamental right the petitioner has He also asked Kamat to establish that Hijab is part of a religious practice We are not talking about any restriction We are just talking about your right which you insist for CJ Awasthi said Responding Kamat told the bench that the right derives from Quran and Hadis On January one six girl students of a college in Udupi attended a press conference held by the CFI in the coastal town protesting against the college authorities denying them entry into classrooms wearing hijab This was four days after they requested the principal permission to wear hijab in classes which was not allowed Till then students used to wear the headscarf to the campus but entered the classroom after removing it college principal Rudre Gowda had said The institution did not have any rule on hijab-wearing since no one used to wear it to the classroom in the last 35 years The students who came with the demand had the backing of outside forces Gowda had said PTI GMS GMS SS SS
