Mumbai Nov 29 PTI The Bombay High Court on Monday quashed and set aside the order of a single bench of the HC that had refused to restrain Maharashtra minister Nawab Malik from making public statements against the Narcotics Control Bureaus NCB zonal director Sameer Wankhede and his family A division bench of Justices S J Kathawalla and Milind Jadhav quashed and set aside the order after Malik and Wankhedes father Dnyandev consented that the single bench order be recalled and Dnyandevs grievances against the minister raised through an interim application on his defamation suit filed against Malik be heard afresh by the HC On November 22 a single bench of Justice Madhav Jamdar held that though Maliks tweets against Wankhede particularly those pertaining to allegations of the NCB officer having submitted a false caste certificate to secure the central government job and having accepted illegal gratification while on duty had stemmed out of malice the minister couldnt be completely prohibited from making comments against a public officer Dnyandev then challenged the singe bench order While hearing the appeal last week a division bench of Justices S J Kathawalla and Milind Jadhav held that Maliks statements and tweets against Wankhede did seem to be a clear case of malice and logically he should be restrained from making such comments The bench had also asked if it behoved the minister to make such comments without due verification and why he hadnt first approached the caste scrutiny committee with a formal complaint against Wankhede Malik then proposed that the single bench order be recalled His counsel Karl Tamboly told the HC that Malik will consent to quashing of the order he will file a detailed reply to Dnyandevs interim application and he will not make public statements or tweets against the Wankhedes until further hearing He sought that Dnyandevs application be heard afresh by the single bench On Monday senior counsel Birendra Saraf who appeared for Dnyandev told the division bench that his client had consented to the quashing of the November 22 order The court can say by consent of parties quashing of the order Saraf said The division bench permitted Malik to file a fresh reply affidavit to Dnyandevs interim application that seeks among other things that until his suit is heard finally the minister be restrained from making defamatory statements against him and his family Malik will submit his reply by December 9 Dnyandev will then file his rejoinder responding to Maliks affidavit by January 3 The single bench of Justice Madhav Jamdar will then hear the interim application afresh and complete the hearing within 13 weeks the division bench said Until the hearing on the interim application is complete Malik will not make any public statements or tweets against the Wankhedes the division bench said The statement by respondent Malik on not tweeting or making public statements against the Wankhedes shall continue pending disposal of final order on the interim application the bench led by Justice Kathawalla said Malik has levelled a string of allegations against Sameer Wankhede after he led a drug bust raid on a cruise ship last month following which actor Shah Rukh Khans son Aryan Khan and some other people were arrested The minister had alleged that Wakhede was born a Muslim but falsely claimed to belong to a designated scheduled caste to secure his central government job Wankhede has denied the allegations PTI AYA GK GK

Mumbai Nov 25 PTI Maharashtra minister and NCP leader Nawab Malik told the Bombay High Court on Thursday that he will not post any tweets or make any public statements against NCBs zonal director Sameer Wankhede his father or any of their family members till December 9 the next date of hearing The assurance came after the high court asked the minister whether he has lodged a complaint with the caste scrutiny committee regarding his allegations against Sameer Wankhedes caste credentials and said if he has not done so what was his intention behind the media publicity which it said does not befit a minister The statement on Maliks behalf was made by his counsel Karl Tamboly before a bench of Justices S J Kathawalla and Milind Jadhav after it said that it was inclined to pass an order restraining the minister from making public comments against the Wankhedes till further hearing The bench said that it was apparent that Maliks tweets had stemmed out of malice Why is the minister behaving like this Why should he behave like this we want to know This is nothing but malice Please read the dictionary meaning of malice the HC said The bench was hearing an appeal filed by Dnyandev Wankhede father of Sameer Wankhede challenging the order of a single bench of the high court that had refused on November 22 to restrain Malik from making defamatory statements against him and his family Senior counsel Birendra Saraf who appeared on behalf of Dnyandev before the bench led by Justice Kathawalla submitted that the single bench had recorded in its order that Malik had made allegations against Sameer Wankhede pertaining to his religion and his having received illegal gratification while on duty without due verification The findings of the single bench are that the tweets by Malik had actuated out of malice and animosity and yet no relief was granted to me Dnyandev Saraf said The single judge says that he Malik disregarded the truth and that the documents he submitted in court were either interpolated or not verified he said Saraf further said that the minister had made comments not just against Dnyandev and Sameer Wankhede but against their other family members too He Malik has spared no onemy daughter my dead wife This morning too he has tweeted Saraf said referring to a tweet made by the minister on Thursday morning wherein he posted an image of a document that he called pertained to the last rites of Dnyandevs wife and showed her religion as Muslim Saraf further said that Malik had submitted documents in court casual without verification Tamboly however said that the NCP leader had submitted verified documents before the single bench on affidavit to prove several allegations made against the Wankhedes including the claim that Sameer Wankhede though born a Muslim had falsely claimed in his caste certificate to belong to a designated Scheduled Caste SC category to secure his central government job At this the bench asked if Malik had made any formal complaint before the caste scrutiny committee When Tamboly said no such complaint had been made yet the bench asked why Malik was then making such public statements Any complaint made to the caste scrutiny committee If no then what is he trying to prove Is this for media publicity For claims of caste falsities everyone has a redressal forum the caste scrutiny committee the high court said If there is a caste certificate in his Maliks favor then instead of all this media publicity that he wants everyday especially after his son-in-law was arrested by wankhede why not approach the committeeHe is a ministerdoes it befit him to do all this the bench asked The court further said that if it was obvious that Maliks tweets had actuated out of malice and the same had been recorded as a categorical finding of the single bench then what must logically follow was that the minister be restrained from making further comments until Dnyandev Wankhedes appeal was heard finally by the court Tamboly then sought time to take instructions He said that Maliks daughter-in-law was present in court and that they has decided that instead of getting into a controversy I Malik will not tweet or say anything until the final hearing The high court accepted Tambolys statement but asked why was the ministers daughter-in-law present in the court room when she was not a party to the case Is the ministers entire family involved in this Why is she here the HC asked It however took on record Tambolys statement that no tweets and public statements shall be made against the plaintiff Dnyandev Wankhede and his family members through any means of publicity whether directly or indirectly until December 9 the next date of hearing PTI AYA NP NP

Mumbai Nov 18 PTI The Bombay High Court on Thursday said it will pass an order on November 22 on a plea filed by Dnyandev Wankhede father of NCBs zonal director Sameer Wankhede seeking interim reliefs against Maharashtra minister Nawab Malik including an injunction prohibiting him from posting any defamatory content on social media against him and his family A single bench of Justice Madhav Jamdar on Thursday took on record additional documents submitted by Malik and Dnyandev Wankhede related to the ongoing controversy over the NCB officers caste certificate Malik has been alleging that Sameer Wankhede though born a Muslim had secured a central government job claiming to be from the Scheduled Caste category But Wankhede has denied the allegations levelled against him The documents that both the parties submitted before the court on Thursday include Sameer Wankhedes birth certificate and his school leaving certificate Malik submitted a letter by the Public Health Officer of the Brihanmumbai Municipal Corporation BMC with a copy of the declaration pertaining to the change of name of Sameer Wankhede and two school leaving certificates issued for Wankhede by St Josephs High School and St Paul High School in the city in the 1980s All of these documents Malik claimed showed that Wankhede was born a Muslim and that his fathers real name was not Dnyandev but Dawood As per Maliks claims made before the high court the name of the NCB officers father was Dawood K Wankhede and it was only in 1993 that he got it changed to Dnyandev Wankhede Dnyandev Wankhede however countered Maliks claims and submitted a digitised birth certificate issued by the BMC for Sameer Wankhede and his own caste certificate Dnyandev Wankhedes counsel advocate Arshad Shaikh said these two documents show that Sameer Wankhedes fathers name had always been Dnyandev and that the NCB officer was born a Hindu and belonged to Mahar community a Scheduled Caste He said Sameer Wankhedes birth certificate had initially mistakenly mentioned his fathers name as Dawood but the same had been corrected way back Advocate Shaikh further argued that Malik had been tweeting and making defamatory statements against the Wankhedes without verifying facts He said that as per Maliks own documents submitted in the high court the minister received Sameer Wankhedes birth certificate two days ago in response to his RTI query although he had been making statements on the NCB zonal director being a Muslim and lying about his caste certificate even before receipt of copies of his birth certificate Shaikh further told the high court that the NCP leader must stop calling Dnyandev as Dawood He Malik should not continue to call me Dawood since it was corrected to Dnyandev way back Somehow for the last four days he kept quiet Then he has started again said Shaikh Whether his birth certificate is right or mine that has to be seen he told the high court The documents were submitted and the arguments were made over a defamation plea filed by Dnyandev Wankhede seeking several reliefs against Malik Dnyandev Wankhede had sought as an interim relief a temporary injunction restraining Malik from making any statements in the future about Sameer Wankhede or his family On November 12 the high court had reserved its order on the aspect of interim relief sought by Dnyandev Wankhede in his defamation suit However on November 16 Malik moved the high court seeking its permission to place on record additional documents On Thursday after taking the above-mentioned documents on record Justice Jamdar reserved his order on the interim application filed by Dnyandev pertaining to the temporary injunction against Malik The high court said it will pronounce its order on the same on November 22 The high court directed both the parties to refrain from submitting any fresh documents until it pronounces its order on November 22 The NCB officers father had filed a defamation suit against Malik earlier this month in the high court seeking among other things that the minister be restrained from posting defamatory statements against him and his family on social media He has also sought damages worth Rs 125 crore Malik has been fiercely attacking Sameer Wankhede after the Narcotics Control Bureaus raid on a cruise party last month following which around 20 people including actor Shah Rukh Khans son Aryan Khan were arrested Aryan Khan and some other accused were later released on bail PTI AYA NP NP
