New Delhi Nov 25 PTI The Special Investigation Team SIT on Thursday told the Supreme Court that the allegation of a larger conspiracy in the 2002 Gujarat riots has been blown out of proportion by claiming that several persons in the then state government right from the highest to the lowest were complicitThe SIT told a bench headed by Justice A M Khanwilkar that they have examined everybody right from the then Gujarat Chief Minister to others and devoted a huge amount of time on all the issues raised in the complaint filed by Zakia Jafri who has alleged larger conspiracy during the riotsZakia Jafri the wife of slain Congress leader Ehsan Jafri who was killed at Gulberg Society in Ahmedabad on February 28 2002 during the violence has challenged the SITs clean chit to 64 people including Narendra Modi the then Gujarat chief minister during the riotsWhat I am trying to submit is that it is being blown out of proportion completely blown out of proportion by saying that everybody in the state government from the highest to the lowest everybody in the political class everybody in the state administration everybody in the police is complicit senior advocate Mukul Rohatgi appearing for the SIT told the benchRohatgi told the bench also comprising Justices Dinesh Maheshwari and C T Ravikumar that there were allegations made about some glaring examples of state-sponsored eventsSee the impact of this That is why I have said this case has gone haywire he said adding What do you mean by state-sponsored Does it mean that people in the administration the political class have sponsored these riotsArguing that there was nothing to substantiate the allegation of a larger conspiracy he said that SIT had investigated all the aspects examined relevant materials and then filed a report before the trial courtThe SIT examined everybody from the chief minister downwards major people in the cabinet including the chief minister top police officials top civil administration officers all this was done It is not as if they SIT did not examine the chief minister or anybody else he said during the arguments which would continue on December 1The senior advocate said the allegation that there was undue delay in deployment of the Army during the violence in the state was not justifiedHe said Army was called the same day and deployed and this destroy the allegations of conspiracy whether by the political class the state government or the policeWhy did not the government do this why did not the government transfer this these are not meant to be criminality or conspiracy But yet this SIT devoted a huge amount of time on all these issues They did not leave a single issue by saying it is beyond our remit he saidDuring the hearing the bench asked Rohatgi whether the petitioner had participated in the trial which was going on before the trial courtHe said Zakia Jafri was examined as a prosecution witness during the trialThe bench told Rohatgi that if her evidence is available it can be placed on recordThe senior advocate also told the bench that 19 out of the 275 persons examined by the SIT were prosecution witnesses in the Gulberg caseRohatgi told the bench that during the arguments before the apex court Zakia Jafri has not pressed the issue regarding the complaint against the then chief ministerThe bench asked senior advocate Kapil Sibal who is appearing for Zakia Jafri about itAll matters which require further investigation I have read to your lordships Sibal said adding I have purposely not read any part of any allegation against the then CMHe said the petitioner was not asking for any further investigation on the meeting of February 27Rohatgi said the court may note that allegation against the then chief minister in the complaint or what was recorded in the closure report and accepted by the court below is not being assailedTo this Sibal said That is not being pressed for further investigation Tomorrow if there is some other evidence that comes up I dont know I have no idea That is the law of this country that if tomorrow any other fresh evidence comes up which is not available today 2017 order rejecting her plea against the SIT decision The high court in its October 2017 order had said the SIT probe was monitored by the Supreme Court However it partly allowed her petition as far as its demand for a further investigation was concerned saying she can approach an appropriate forum including the magistrates court a division bench of the high court or the Supreme Court seeking to conclude that there was any larger conspiracy as alleged by Zakia JafriZakia Jafri the wife of slain Congress leader Ehsan Jafri who was killed at Gulberg Society in Ahmedabad on February 28 2002 during the violence has challenged the SITs clean chit to 64 people including Narendra Modi the then Gujarat chief minister during the riotsSenior advocate Mukul Rohatgi appearing for the SIT told a bench headed by Justice A M Khanwilkar that it is very unfair to say that SIT did not do its jobRegarding the allegation that appropriate steps were not taken by the state authorities during that period to prevent riots Rohatgi said the violence started on February 28 and on the same day the then chief minister had called a meeting and a decision was taken to call the ArmyWe SIT were not shielding anybody Rohatgi told the bench also comprising Justices Dinesh Maheshwari and C T Ravikumar Really speaking there is nothing in this case except to go on filing thousands of pages and trying to tell a court that we SIT did not do our job the former Attorney General saidHe said there were allegations about the presence of two ministers in the control room during the violence and the SIT examined every relevant person and found that one had visited there while the other had not Rohatgi said the minister who had visited there was sitting in a separate roomThe SIT found nothing wrong in the minister going there for half-an-hour he said adding Presence of minister will help the police It will help the morale of the police that the minister is not hiding in his house At the outset the senior advocate told the bench that he would endeavor to show that SIT had conducted its job very thoroughly and efficiently and examined all relevant people all relevant materialsReferring to the sequence of events starting from the 2002 Godhra train incident in which the S-6 coach of Sabarmati Express was burnt killing 59 people Rohatgi said violence had started a day after on February 28On February 28 the chief minister called a meeting and a decision was taken to call the Army he said adding that a fax message was also sent to the Union Home Ministry and there was no delay in this processRegarding Zakia Jafris contention that SIT did not probe several aspects Rohatgi said the SIT was entrusted a job by the apex court and it did a very extensive inquiry and examined 275 personsIt was only to ensure that nobody can point a finger at the SIT that they were partisan because allegations were flying thick and fact from 2002-2003 he saidIt is very unfair to say that the SIT did not do its job I will show what they did They did their job You may or may not agree with it that is a different thing But they should not be accused of not doing their job he said during the day-long arguments which would continue on ThursdayThe senior advocate said a lot was argued about the alleged parading of bodies of train incident victims but the argument has no substance at allRegarding the allegation that SIT did not consider the tapes of a sting operation Rohatgi said the statements made in them inspired no confidence and there was no material to support themHe said there were nine cases related to the riots in which charge sheets and several supplementary charge sheets were filed by state policeThe senior advocate said after the SIT took over the probe several supplementary charge sheets were filed and many accused were added in these casesDealing with Zakia Jafris argument that SIT did not examine the relevant call detail records CDRs of that period Rohatgi said by the time SIT came for investigation around eight years have gone by and companies do not keep CDRs for so longWe SIT found no evidence either of parading which could have added fuel to the fire We found no evidence that police or state was complicit in getting the post-mortem wrongly done he said Regarding the allegation that some public servants were transferred at that time he New Delhi : The Supreme Court on Tuesday objected to Zakia Jafri – the widow of Congress MP Ehsan Jafri, who was killed in the 2002 Gujarat riots – alleging “collaboration” between the SIT probing the violence and some of the accused, including then Gujarat Chief Minister Narendra Modi, given a clean chit.
“Collaboration is a strong term for a SIT constituted by the court,” a three-member bench of Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar said in response to senior advocate Kapil Sibal talking about “glaring evidence of collaboration” and asking “Was (the) SIT saving some people?”
“It could be collaboration with the police.
