New Delhi Feb 21 PTI The Delhi High Court Monday asked the Delhi Police to file a status report on a plea seeking to reopen a spa and wellness clinic which is being prohibited to carry out the business despite DDMAs order permitting such centres to reopen with certain conditions and restrictionsJustice V Kameswar Rao said the Delhi Police shall file the status report within two days and listed the matter for further hearing on February 28Delhi Police counsel Satyakam submitted that the spa centres where alleged sexual activities were going on will remain closed and those which are running as per the Commercial Health Trade Licence can go onThe court was hearing a petition by Sukhbir Singh who is running his spa and wellness clinic in the name of White heaven Spa and Wellness challenging the arbitrary unlawful and unjustified actions of the authorities in not allowing him to operate the centreHe claimed that he has been complying with all norms rules and regulations issued by the competent authoritiesAdvocate Rajeshwar Dagar appearing for the petitioner said unless he was allowed to open the spa centre how can the authorities conclude that any illegal activities were going on thereThe plea said the petitioner got a licence to operate the spa centre in April 2021 and in December the same year some police officials barged into the premises and forcibly took into custody all male and female staff working there allegedly cooked up a false story against themOn December 28 2021 following the order of the Delhi Disaster Management Authority DDMA the petitioner had to close down his spa business on account of COVID-19 and on February 4 this year the authorities permitted spa and wellness centres in the national capital to reopen subject to certain conditions and restrictions it saidHowever when the petitioner tried to open his spa he was stopped by the police officials on the ground that there are strict orders from the SHO of Mohan Garden that no spa shall be opened within his jurisdiction at any cost and if any spa is found opened the spa owner and the building landlord will be prosecuted and FIR shall be registered against them PTI SKV RKS RKS

New Delhi Jan 24 PTI The Delhi High Court Monday directed the Delhi Police and NDMC to continue removing unauthorised hawkers selling goods in the Sarojini Nagar market here while noting that the authorities have taken effective steps in this directionSubstantial work has been done We would like this momentum to continue a bench of Justices Vipin Sanghi and Jasmeet Singh saidAfter perusing the status reports filed by the New Delhi Municipal Council NDMC and Delhi Police the bench said they have done the work it is not that shopkeepers are not to be blamed Almost every shopkeeper has encroached upon public land It appears that in pursuance to our orders NDMC and police authorities have taken effective steps regarding removal of illegal squatters in Sarojini Nagar market We would like to see further steps be taken in the matter We direct NDMC and Delhi Police to continue to keep vigil and remove illegal squatters and ensure our orders are complied with it saidThe bench said it was the question of peoples mindset as they see whether the authorities are lenient or strictYou have to send a message home that you will take strict action and then see the result If we take back the contempt notices things will go back to the same situation it saidThe court had earlier issued contempt notice against officials of NDMC for not complying with its earlier orders on the removal of encroachment from the market including illegal vendors and their goodsThe court asked the NDMC to mention in its next status report the steps taken by it for fencing Sarojini Nagar MarketIt further asked the Delhi Police to indicate the aspect of procurement of instruments for a headcount of people in the market and also on the installation of CCTVs thereThe high court was hearing a plea relating to illegal encroachments in Sarojini Nagar market and the presence of unauthorised vendors and squatters thereThe petitioners counsel said the system of odd-even of the opening of shops is going on so shopkeepers are not allowed to keep their shops open daily however these hawkers sit there every day and are squatting just outside the shopsThe high court in December last year had said the state of affairs be it Covid or non-Covid was frightening as people were flowing like a river which could lead to stampede and death of hundredsIt had taken note of overcrowding in Sarojini Nagar market which had witnessed a bomb blast in the pastThe court had said whether there is Covid or not people have to remain alert and made it clear that if there is any death because of COVID-19 infection or stampede in the Sarojini Nagar market then the officials of the authorities concerned NDMC and Delhi Police will be personally held liable for itIt had also asked the Delhi Police and Delhi Disaster Management Authority DDMA to work out a movement plan for the public in the market and asked the NDMC and other authorities to ensure there is no overcrowdingIt had further directed the DDMA to make a visit to the market forthwith and assess the situation given the prevailing situation of the pandemicThe NDMC counsel had said they have been regularly removing encroachment and also illegal vendors but they again return and that they are also issuing challans and performing their duties PTI SKV SKV RKS RKS

New Delhi Jan 20 PTI The Delhi High Court Thursday directed the Delhi Police and North Delhi Municipal Corporation NrDMC to conduct drives for removing all unauthorised hawkers and vendors from no-hawking zones of Chandni Chowk and Subhash Marg hereA bench of Justices Vipin Sanghi and Jasmeet Singhs order came after perusing several photographs filed by Chowk Sarv Vyapar Mandal showing illegal and unauthorised hawking activities being carried out in Chandni Chowk and Subhash MargThe court asked the SHO of Kotwali Police Station and the Deputy Commissioner of NrDMC to conduct the drives and file an action taken report within a weekThe court was hearing a plea by Chandni Chowk Sarv Vyapar Mandal represented through senior advocate Sanjeev Ralli and lawyer Mohit Mudgal seeking direction to the authorities to remove illegal hawkers and vendors from the no-hawking and no-squatting area in Chandni Chowk which has recently undergone redevelopmentThe high court had earlier said that anybody who was encroaching upon public space must be removed and it cannot be permitted that the whole pavements in markets are covered with encroachment leaving no space for people to walkIt had also asked the municipal corporation to prepare a street vending plan They cant be permitted that the whole pavement is covered with encroachers and making it impossible for people to walk Please please for Gods sake do the planning and do not make communications at the last moment the high court had earlier said adding that NrDMC does not seem in any urgency to formulate a plan so that hawking activity could be organisedIt had also directed the Delhi Police to positively take steps on the installation of CCTV cameras at Chandni Chowk area before February 28 failing which the Commissioner of Delhi Police shall remain present before itIt had said it was trying to fill up a void which is there in the law Street Vendors Act and added that it does not want all these poor people to be driven away but things have to be done properly with a planThe court had directed that experts be nominated from Shahjanabad Redevelopment Corporation Delhi School of Planning and IIT Delhi immediately without any delay in the matter relating to the preparation of the street vending planIt had also asked the Delhi Police to take steps for the removal of encroachers and illegal vendors from the area and directed the police and North MCD to continue with their anti-encroachment driveRalli had submitted that despite repeated directions of the court Delhi Police has not yet installed 330 CCTV cameras in the area to check encroachment in the area and pathways and this has been the casual approach of the authoritiesThe court had earlier observed that there was no executive or political will to remove illegal hawkers and vendors from streets and barring Lutyens Delhi there was no place in the city that was clear from unauthorised squatters PTI SKV SKV RKS RKS

New Delhi Oct 25 PTI The Delhi High Court Monday asked Delhi police to reconsider its decision to withdraw the personal security provided to a lawyer involved in a case concerning the Ram Janmabhoomi before the AllahabadHigh Court Justice Rekha Palli who was hearing a petition against the withdrawal by lawyer R P Mehrotra -- who represented the Centre and the Archaeological Survey of India in the case granted two weeks to the police to reconsider the decision and place its report as well as the original records before the court Listing the matter for further hearing on November 15 the judge orally asked Delhi Police counsel to ask them police to start giving one security personal for the present Before the petition is considered on merit it is deemed appropriate to direct respondent no 2 Delhi Police to reconsider its decision within two weeks from today While reconsidering respondent no 2 will also consider the petitioners averment that similarly placed advocates are still getting the same security and the threat perception may not have disappeared the court ordered Senior advocate Sidharth Luthra appearing for the petitioner said that police protection was given to the lawyer pursuant a direction passed by the Allahabad High Court in September 2013 In spite of the high courts direction that it cannot be lifted the authorities withdrew the security cover based on a factually incorrect premise that Mehrotra represented a certain Hindu organisation in the case instead of the official parties he said Luthra further objected to the polices stand of no threat perception presently against Mehrotra and highlighted that the decision for withdrawal was based on the opinion of a legal advisor when other similarly placed lawyers from the case were still being given the security as directed by the Allahabad High Court Delhi Police counsel Sameer Vashisht told the court that security cant be in perpetuity and the petitioner may provide some proof to show the existence of threat in order to assist the authorities In its petition the petitioner said that since 2013 personal security was being provided to him in view of the specific directions issued by the Lucknow Bench of the Allahabad High Court which was withdrawn by the Delhi Police in December 2020 The petitioner claimed that the withdrawal was without any notice and was wholly arbitrary and unjustified as it overlooked the fact that the threat from certain organisations on the basis of which the security cover was granted in the first instance was still continuing The court had issued notice on the petition in August PTI ADS SA
