Guwahati Apr 22 PTI A Russian malware planted from a server in Nigeria was used for a recent cyber attack on Oil Indias OIL system in Assams Duliajan which had brought down the PSU majors network a top police official said on Friday The OIL system is yet to be restored completely even after 10 days of the incident they added A top police official who wished not to be named told PTI that their investigations indicated the cyber attack was carried out from overseas He said We have found that a Russian malware was used in it And someone individual or group planted it from Nigeria We are working out the details and also ascertaining whether it was planned attack or a random one that hit OIL the official added The cyber attack took place on April 10 on one of the workstation of Geological and Reservoir department of OIL but it was intimated by the IT department on April 12 The OIL server network and other related services were affected as a result The cyber attacker has demanded 7500000 over Rs 57 crore as ransom through a note posted on the infected PC When contacted OIL spokesperson Tridiv Hazarika told PTI that different government agencies were carrying out the investigation into the incident Whether its a random virus attack or one by typical cyber criminals - domestic or international we will know after investigation he said Besides Assam Police and Intelligence Bureau experts from CERT-In and NCIIPC are helping in the probe he added These two organisations deal with cyber-security related matters including probing against hacking and phishing attacks Hazarika said The government is taking it very seriously and doing a thorough probe He said systems are being restored in a phase-wise and many computers are already functioning Operations were not affected at any stage of the cyber attack the spokesperson added OIL had approached the Dibrugarh Police on April 13 which registered a case under section 385 of the Indian Penal Code extortion read with sections 66 dishonesty and fraudulence and 66F cyber terrorism of the Information Technology Act 2000 PTI SSG JRC JRC

New Delhi Dec 19 PTIThe Delhi High Court has granted bail to three persons accused of duping a seller on an online marketplace stating that while online cheating and fraud have become rampant it cannot remiss in performing its duty of upholding libertyJustice Subramonium Prasad warned the three accused not to indulge in the same offence again and ordered that their bail would be subject to furnishing bail bonds of Rs 25000 with the two sureties of the like amountThe judge stated that since the investigation was complete and the charge sheet stood filed no useful purpose would be served by keeping the petitioners in further custodyThis court is aware that this kind of online cheating and fraud have become rampant in most parts of the country However this court cannot remiss in performing its duty that is to uphold liberty subject to other relevant considerations the court said in its order dated December 13Since the investigation has been completed and the charge sheet has been filed before the learned trial court and taking into account the evidence are primarily documentary in nature this court therefore is of the opinion that no useful purpose will be served by further keeping the petitioners in custody it addedThe court directed the petitioners to report to the police station concerned twice in a week and not tamper with evidence or influence the witnessesThe court also asked the petitioners to give all their mobile numbers to the investigating officer and keep them operational at all timesIn the present case the complainant alleged that she had uploaded certain articles for sale on an online platform but was duped by the petitioners into transferring Rs 34000 to them through online payment modeAfter the registration of an FIR charge sheet was filed against the petitioners for the alleged commission of several offences under the Indian Penal Code including forgery and Section 66D cheating by personation by using computer resource of the Information Technology Act 2000 The trial court had rejected the petitioners bail applications on the ground that they were accused of embezzlement and used clever devices to cheat many innocent persons on the internetThe prosecution opposed the bail applications before the high court saying that petitioners are accused of executing the crime in a very organised way and the charge of forgery prescribes a punishment of 10 years extending up to life imprisonmentThe court was informed that the petitioners created bank accounts giving false details in order to evade arrest and purchased SIM cards in fictitious names which were used to defraud and cheat gullible people who sold and purchased goods from the internetThe prosecution added that the petitioners did not just defraud the present complainant but many other persons and the same was being investigatedThe complainant also opposed the bail applications and submitted that online fraud has become widespread in north India whereby many innocent people have been cheatedThe petitioners sought bail on the grounds that they have been in custody for 10 months and their further custodial interrogation was not required PTI ADS DV DV

Karnataka govt tables bill in assembly to ban online gambling

Bengaluru Sep 17 PTI The Karnataka government on Friday tabled a bill in the assembly to ban online gambling or betting in the state and providing for a maximum imprisonment of three years or fine of up to Rs one lakh for any violation The Karnataka Police Amendment Bill 2021 was tabled in the assembly by Home Minister Araga Jnanendra The bill to amend the Karnataka Police Act of 1963 states games means and includes online games involving all forms of wagering or betting including in the form of tokens valued in terms of the money paid before or after the issue of it or electronic means and virtual currency electronic transfer of funds in connection with any game of chance However it does not include lottery or wagering or betting on horse races run on any race course within or outside the state The Bill in its statement of objects and reasons says that it is considered to amend the 1963 Police Act to provide for enforcement of provisions of the Act by making offences under certain sections as cognizable offence and non-bailable except Section 87 gaming in public streets which is made cognizable and bailable It will include the use of cyberspace including computer resources or any communication device as defined in Information Technology Act 2000 in the process of gaming to curb the menace of gaming through internet and mobile apps It provides for enhancing punishment for gaming to wean citizens away from the vice of gambling extending to three years and fine up to Rs one lakh It said the punishment for the first offence would be six months imprisonment and fine of Rs 10000 for the second one year imprisonment and fine of Rs 15000 and for the third offence 18 months imprisonment and fine of Rs 20000 Persons aiding or abetting such online gaming would also be punished it added There is no extra expenditure involved in the proposed legislative measure it said Instruments of gaming include any article intended to be used as a means of gaming including computers computer system mobile app or internet or cyberspace virtual platform computer network computer resource any communication device electronic applications software and accessory the bill said Also means of online gaming any document register or record or evidence of any gaming in electronic or digital form the proceeds of any online gaming or any winning or prize in money or otherwise distributed or intended to be distributed in respect of any gaming it added The state government had in July informed the High Court hearing a petition seeking a ban on all forms of online betting and gambling that it had drafted a Bill Last November Tamil Nadu had promulgated an ordinance banning online gambling and earlier this year Kerala too had imposed a ban on online rummy games PTI KSU APR APR
