New Delhi Oct 22 PTI A court here has come down heavily on the Delhi Police Commissioner for non-submission of a report in a 2020 riots case and sought an explanation from him as to why appropriate action as per law be not taken against him Chief Metropolitan Magistrate Arun Kumar Garg on September 25 had imposed a cost of Rs 5000 on the police after noting that the investigating officer and prosecutor sought adjournment in a very casual manner and had directed the police commissioner to conduct an inquiryAlmost a month after the order the magistrate on October 21 waived the cost imposed on the police but noted that although a request for extension of time for completion of the inquiry as per directions of the police commissioner has come from DCP North East no report has been received from the commissioner Let an explanation be called from Commissioner of Police Delhi under his signatures through Secretary Home Union of India as to why appropriate action as per law be not taken against him for non-submission of the report in terms of the previous order the court saidThe court also cautioned the police commissioner and DCP North East that it will hold them personally responsible for the imposition of cost in case the investigating officers seek an adjournment for compliance with the orders in a riots caseThe court had earlier imposed the cost while dealing with a case wherein the investigating officer was directed to supply a copy of the e-challan to the accused named Komal Mishra However the IO informed the court that the copy of the e-challan could not be supplied to the accused as he was not aware of the courts orderPTI AAK RKS RKS

New Delhi Oct 18 PTI A Delhi court has imposed a fine on the police for the undue harassment of the accused in a February 2020 riots case noting that repeated directions to the police commissioner and other senior officers seeking their personal intervention in these matters had fallen on deaf earsChief Metropolitan Magistrate Arun Kumar Garg directed the police to pay a fine of Rs 25000 for delay in moving an application for segregation of complaints and conducting further investigation in the case to all the seven accused in equal proportion Repeated directions have already been issued by this court not only to DCP NE Joint Commissioner of Police Eastern Range and Commissioner of Police Delhi seeking their personal intervention in the matters pertaining to the North East riots however it appears that all the aforesaid directions have fallen on deaf ears the judge stated In an order dated October 12 Garg had also directed Delhi Police Commissioner Rakesh Asthana to furnish a detailed report regarding steps taken by him to ensure proper investigation of the cases pertaining to North East riots and their expeditious trial Furthermore the judge directed the Secretary Home Union of India to order an inquiry to fix the responsibility for imposition of the cost and deduction of the same from the salary of the erring officer The cost was imposed after the police made a request for adjournment in the case on grounds that further investigation in the case was being carried out in the wake of an order passed by a sessions court on September 10 In September the Additional Sessions Judge had questioned why five riot incidents which took place at three different blocks of Delhis Bhajanpura area on different dates were clubbed in a single FIR and had directed that the complaint of one Akil Ahmad be separated During the proceedings before the magistrate court even though the Special Public Prosecutor SPP stated that the complaint of Ahmad was segregated there was no whisper regarding the segregation of his complaint in a status report filed by the investigating officer IO the judge noted When the IO was directed to produce the case diary to show the investigation carried out by him after the September order it was submitted by him that no such case diary has been written in the present case after the sessions courts orderIn view of inconsistency in the submissions made on behalf of IO as well as SPP regarding segregation of investigation qua the complaint it is apparent that the prosecution is still not sure as to how it should go about further investigation in the case and the only purpose for seeking permission for further investigation is to derail the further proceedings the court observed He added The request of IO for segregation of the complaint and for further investigation in the case is allowed however considering the delay in moving the application leading to undue harassment of theaccused persons two of whom are still running in JC the said request is allowed subject to adjournment cost of Rs 25000 to be paid by the State Communal clashes had broken out in northeast Delhi in February 2020 after violence between the Citizenship Amendment Act supporters and its protesters spiralled out of control leaving at least 53 people dead and over 700 injured PTI AAK DV DV

Delhi riots Court orders Rs 5k salary cut of errant cop for casual approach

New Delhi Sep 28 PTI Irked over Delhi Police seeking adjournment in a very casual manner in a riots case a court here directed the police commissioner to conduct an inquiry and deduct Rs 5000 from the salary of the responsible officer Chief Metropolitan Magistrate Arun Kumar Garg imposed the fine after the police failed to comply with a previous order in which he had directed the investigating officer IO to supply a copy of an e-challan to one of the accused and sought an adjournment to supply itThe judge said Under the circumstances request for an adjournment for compliance of order dated April 12 2021 is hereby allowed subject to cost of Rs 5000 to be deposited by Delhi Police in the Prime Minister National Relief Fund In his September 25 order the judge added this court is not oblivious of the fact that burden of this cost shall fall on public exchequer and hence I deem it appropriate to direct Commissioner of Police Delhi to conduct an inquiry and to order deduction of aforesaid cost from the salary of the responsible officer The judge noted that the special public prosecutors SPPs and IOs do not appear in the cases on the dates fixed and when they appear after prodding it is without inspection of the file and then seeks adjournment in a very casual manner He said that the conduct of the police as well as the prosecutor has already been brought to the notice of senior police officers including the Commissioner of Police however they have failed to ensure that such incidents do not take place anymore The court was dealing with a case wherein the IO was directed to supply a copy of the e-challan to the accused named Komal Mishra in compliance with an order dated April 12 2021However the IO informed the court that the copy of the e-challan has not yet been supplied to the accused as he was not aware of the court orderPTI AAK RKS RKS
