The Supreme Court on Friday rejected a plea seeking a copy of the agenda, a copy of the decisions, and a copy of the resolution of a 2018 Collegium meeting and clarified that only a resolution drawn and signed by all the Collegium members can be said to be the final decision.

New Delhi Mar 30 PTI The Delhi High Court on Wednesday dismissed a challenge to the Central Information Commissions order dismissing an RTI appeal seeking the agenda of the Supreme Court collegiums meeting on December 12 2018 when certain decisions were purportedly taken on elevation of judges to the apex courtJustice Yashwant Varma said that in the absence of any formal resolution being adopted and signed by the members of the Supreme Court collegium for the meeting the authorities rightly took the position that there was no material that was liable to be disclosedThe judge who was dealing with the petition by activist Anjali Bhardwaj stated that the collegium is a multi-member body whose decisions stand embodied in resolutions which alone represent the collective decision taken or the majoritarian view which prevailed and was adopted and in the present instance since the issues which arose for discussion remained unresolved or in an inchoate state no formal resolution came to be drawn upHe further observed that there was no ground to doubt that no resolution was drawn in relation to the said meeting of the collegium and no cogent material has been placed on the record which may convince the Court to take a contrary view The resolution of the Collegium of 10 January 2019 specifically records that although certain decisions were taken since consultation could not be completed and the winter vacation of the Court intervened the agenda items of 12 December 2018 were again deliberated upon by the Collegium on 56 January 2019 when it was decided that it would be appropriate that the proposals be re-evaluated in light of the additional material that had become available the court said From the aforesaid recitals of facts it is manifest that in the absence of any formal resolution coming to be adopted and signed by the Honble members of the Collegium on 12 December 2018 the respondents have rightly taken the position that there was absence of material that was liable to be disclosed it addedThe court further said that the petitioners submissions addressed in the backdrop of certain newspaper reports are noticed only to be rejected as such reports have no evidentiary value and it would be transgressing its limitations if cognizance were to be taken of such unsubstantiated and unverified reportsIn the petition through advocate Prashant Bhushan the petitioner challenged the CICs December 16 2021 order by which her second appeal was dismissed and had sought a direction to the authorities to disclose the available information sought for under the February 26 2019 RTI application The petition had said that on January 23 2019 Justice Madan B Lokur who was a part of the December 12 2018 collegium meeting and retired on December 30 2018 in an interview expressed his disappointment that the December 12 2018 collegium resolution was not uploaded on the Supreme Court website According to former Chief Justice of India Ranjan Gogois autobiography Justice for the Judge the names of Justice Pradeep Nandrajog the then Chief Justice of the Rajasthan High Court and Justice Rajendra Menon the then Chief Justice of the Delhi High Court had received nod for the elevation to the Supreme Court in the collegium meeting on December 12 2018 The matter allegedly got leaked after which the issue was kept in abeyance by Justice Gogoi till January 2019 because of winter break which started on December 15 2018 the book said In January 2019 a new collegium got constituted after the retirement of Justice Lokur The new collegium in its resolution on January 10 2019 did not clear the names of Justice Nandrajog and Justice Menon for elevation to the Supreme Court according to the book The petition has not mentioned names of any judges that were allegedly cleared Initially Bhardwaj had filed an RTI before the Supreme Court seeking copies of the agenda decisions taken and resolutions passed in the December 12 2018 meeting However the Supreme Court Central Public Information Officer CPIO refused to provide the information and while disposing the appeal against the denial by the CPIO the First Appellate Authority FAA had held that in view of the subsequent collegium resolution of January 10 2019 it was clear that though certain decisions were taken in the collegium meeting of December 12 2018 the required consultations could not be completed and no resolution was formally passed The court was further told that in the second appeal the CIC also relied upon the January 10 2019 resolution and held that the agenda of the collegiums December 12 2018 meeting was clear from the subsequent resolution of January 10 2019 and the copy of the decision and the resolution of December 2018 did not exist on record in terms of Section 2 f of the RTI Act and therefore could not be supplied to the petitioner The petition had sought setting aside of the CIC order on grounds that the petitioner has asked for a copy of the agenda of the collegium meeting of December 12 2018 and not a summary or reference thereof PTI ADS SA

New Delhi Jan 31 PTI An inquiry panel set up by the Delhi Commission for Protection of Child Rights to identify the challenges faced by children in conflict with the law about legal aid services has sought submissions from stakeholders over the matterThe deadline for written submissions is February 12Considering that several organizations and individuals have reached out to the commission asserting proclivity to assist the inquiry panel the commission has decided to formally invite written submissions it saidThe Delhi Commission for Protection of Child Rights DCPCR also said selected organizations and individuals may be requested to depose before the inquiry panelThe panel had sought submissions from organizations and individuals involved in legal aid work for children and adults advocates and NGOs working for children in conflict with the law advocates with experience of representing such children families of such children and the children themselves existing or former juvenile justice board members and legal aid lawyers According to DCPCR the inquiry involves assessment of awareness of the legal proceedings and status of the cases and inquiry among children alleged to be in conflict with the law and residing in observation homes places of safety and special homes in DelhiThe inquiry panel will look into the duration of their stay in these institutions along with the reasons and will identify the issues and challenges experienced by such children in securing bail or release and their experiences with the police It will also assess the demographic profile of the family of such childrenThe inquiry panel is headed by Justice Madan B Lokur retired and has three other members -- Sunieta Ojha Sneha Singh and Ajay Verma PTI SLB NSD NSD
