Kochi Feb 23 PTI The Kerala High Court on Wednesday dismissed an appeal against a single judge order upholding the re-appointment of Gopinath Ravindran as the Vice Chancellor VC of Kannur University A bench of Chief Justice S Manikumar and Justice Shaji P Chaly rejected the plea moved by a member each from the varsitys Senate and Academic Council against the single judges order of December 15 last year Senior government pleader V Manu who appeared for the state in the matter confirmed dismissal of the appeal The judgment is yet to be made available The December 15 2021 order had come on the same petitioners plea seeking quashing of a November 23 2021 notification by which Ravindran was re-appointed as the VC While rejecting the plea the single judge had said that there was no violation of any statutory provision in the re-appointment of Ravindran as the VC The court in the December 15 2021 order had said that re-appointment was different from appointment and the procedure adopted for the latter need not be followed when re-appointing someone The petitioners had contended before the single judge that a person can hold office of VC only till the age of 60 years and Ravindran born on December 19 1960 was over age at the time of his second appointment The petitioners had also contended that after the expiry of the four year term of a VC there was no clause for extension and the only option was appointment The single judge had rejected the contentions PTI HMP ROH ROH

Kochi Jan 25 PTI The Kerala High Court on Tuesday said the Prime Minister has every right to give a message on COVID-19 vaccination and ruled his photo in the jab certificate cannot be considered as an advertisement A Division Bench comprising Chief Justice S Manikumar and Justice Shaji P Chaly dismissed an appeal filed against a single judge order junking a plea seeking removal of the Prime Ministers photo from the COVID-19 vaccination certificates The bench said the PMs photo cannot be considered as an advertisement adding the Prime Minister has every right to give out a message on vaccination A Single Bench of the High Court had on December 21 last year dismissed the earlier petition filed by Peter Myaliparampil saying it was frivolous filed with ulterior motives publicity oriented and the petitioner probably also had a political agenda It had imposed a cost of Rs one lakh on the petitioner and he preferred an appeal against the single judge order The court had earlier said that in case of failure to deposit the cost within the stipulated period the Kerala State Legal Services Authority KeLSA shall recover the amount from his assets by initiating revenue recovery proceedings against him It had also said that the petitioner should study the respect to be given to the Prime Minister and others by watching at least the parliamentary proceedings which are available live on national TV The petitioner had contended that the certificate was a private space with personal details on record and therefore it was inappropriate to intrude into the privacy of an individual He had contended that adding the Prime Ministers photo to the certificate was an intrusion into an individuals private space Myaliparampil a senior citizen had contended in his plea that the Prime Ministers photo on his vaccination certificate was a violation of fundamental rights PTI COR RRT SA BN BN

Kochi Aug 25 PTI The Kerala High Court on Wednesday said the court would not interfere with the order of a single judge that put on hold the decision of the State government to include the Christian Nadar community in the list of Socially and Educationally Backward Communities SEBCA Bench of Chief Justice S Manikumar and Justice Shaji P Chaly disposing of a plea of the government against the order of the single judge issued on July 29 said the matter can be considered in detail only by that judgeThe Bench said the State can put forth its views before the single judge who may also be informed of the passing of the Constitution 127th Amendment Bill which restores the power of the State governments to enlarge the list of OBC other backward class categoriesThe State Cabinet which met on June 16 gave the nod to include the community in the SEBC category which would be beneficial for its members in the entrance examinations and in the admission to higher education coursesThe single judge Justice P B Suresh Kumar in his order had said The petitioners have made out a prima facie case of the interim order and under those circumstances the stay on the government order will remain The case set out by the petitioners is that in the light of the provision contained in Article 342-A introduced to the Constitution in terms of the 102nd Amendment with effect from August 15 2018 the State government is denuded of the power to specify any class of persons as socially and educationally backward for the purposes of the Constitution Justice Kumar had saidThe order came on the writ petition from an organisation working for the uplift of socially and educationally backward classes The petitioner-organisation said that in the light of the constitutional amendment it is for the President to make such specifications Therefore the petitioner said the order of the State government was unconstitutional and violative of Article 342-AThe government had included the Christian Nadar community in the OBC list to provide them job reservationThe South Indian United Church SIUC Christian is already included in the SEBC category and there has been a long-pending demand of the other Nadar Christian community to be part of itAccording to a State government order Nadars belonging to Christian religious denominations other than SIUC are included in the list of socially and educationally backward classes for the purpose of providing employment and educational benefits PTI CORR HMP NVG NVG
