Jammu Nov 22 PTI The Jammu and Kashmir unit of CPIM on Monday asked the civil society of Ramban and adjoining areas to come forward and demand the return of the body of Amir Magray -- the third person killed in the Hyderpora encounter last week -- and whose kin claim he was innocent The Left party has been pressing for a judicial probe into the controversial encounter in Srinagar and return of the body of Magray a resident of Gool area of Ramban who was among four persons killed in the incident on November 15 According to police Magray was a militant and got killed along with his Pakistani associate and two others HoweverMagrays father Latief who had himself killed a militant in his village over 15 years ago had refuted the police claim and appealed to the Lieutenant Governor to provide justice to his family and also return his body for proper burial The civil society in Ramban and other areas must come forward and demand the return of the body of innocent Magray who was in Srinagar to earn livelihood for his family Jammu Regional Secretary CPIM Sham Prasad Kesar said in a statement here He said Killing innocent civilians and then even denying their bodies to their families is a huge injustice and against the basic values of humanity Why are authorities afraid of even dead civilians Urging the authorities to return the body of Magray to his family without any further delay Kesar said a judicial probe should be ordered into the killing of three civilians As it has been proven beyond any doubt that Magray was a civilian it is a huge injustice to his family that they are not even allowed to perform his last rites When the bodies of two other civilians killed in Hyderpora were returned why is the government reluctant to return Magrays body to his family the CPIM leader asked He said the government must ensure that those involved in the killing of unarmed civilians are brought to book and punished under the law The probe ordered by the government by an Additional District Magistrate-rank officer in Hyderpora killings is not enough as it is difficult for a middle rung officer to prove something which is contrary to the government claims he said The CPIM leader said We demand a judicial and time-bound probe into the gruesome incident which has shaken the whole Jammu and Kashmir The least the government could do to restore the confidence of people in institutions is to punish the culprits of this heinous crime in a transparent and time-bound manner so that it can serve as deterrence to others in future he said The bodies of Mohammad Altaf Bhat and Mudasir Gul two civilians killed in the Hyderpora encounter were handed over to their kin on Thursday night after they were exhumed following protests by family members that they were innocent and not linked to militancy as claimed by police Police had initially buried them in the Handwara area of north Kashmirs Kupwara districtPTI TAS AB HDA

Srinagar : Bodies of Mohammad Altaf Bhat and Mudasir Gul, two civilians killed in the Hyderpora encounter, were cremated by their family members. The bodies, which were exhumed at Handwara after sundown on Thursday, reached Srinagar around midnight, the officials said. The Officials said that they got to witness an emotional scenario at the residences of Bhat and Gul as soon as their bodies reached Barzulla and Pirbagh. Family Members and relatives were waiting for the bodies broke down, to get the last glimpse of their loved one, before cremation.

Srinagar Nov 19 PTI The Peoples Alliance for Gupkar Declaration PAGD has appealed to President Ram Nath Kovind to ensure that the rule of law prevails in Jammu and Kashmir and those erring officials involved in the killing of civilians in the Hyderpora encounter are brought to book and punished In a letter to the President that was issued to the media on Friday PAGD president Farooq Abdullah said the tragic incident in Hyderpora has evoked enormous public anger In this unfortunate incident three civilians got killed in suspicious circumstances The incident calls for a time-bound judicial probe so that true facts are unravelled and brought in public domain he said PAGD is the alliance of six mainstream political parties in Jammu an Kashmir including the National Conference NC and the Peoples Democratic Party PDP Abdullah who heads the National Conference said such unfortunate incidents widen the gulf between the people of Jammu and Kashmir and the Government of India and therefore are to be avoided at any cost We would remind Your Excellency that the administration of Jammu and Kashmir is being run in the name of Your Excellency by the Lt Governor acting as an agent and therefore an onerous responsibility is placed on Your Excellency to ensure that the rule of law prevails and the involved erring officials are brought to book and punished under law he said He also raised the issue of the practice of taking away bodies of the victims of such incidents and depriving their families of the right to organise their burial in accordance with religious practices In the unfortunate incident of Hyderpora also the bodies of three civilians have been taken away by the security forces and reportedly buried 100 km away from their residences Your Excellency the right to decent burial is well recognised in the Constitution of India as well as in the international humanitarian law The dead bodies cannot be denied the right to burial under any circumstances including the so-called law and order problem The bereaved families likewise also have a right to organise burial of the dead body in accordance with their religious practices he wrote in the letter dated November 18 The PAGD alleged that in the past few years such rights have been violated with impunity In the present case these rights are being denied We would request Your Excellency to intervene in the matter and ensure that the dead bodies are returned to their families so that they can perform their last rites in accordance with their respective religious practices it said The matter is of grave concern and calls for an urgent action Abdullah added The bodies of the two civilians -- Altaf Bhat and Mudasir Gul -- killed during Mondays encounter in Hyderpora area of the city were exhumed at Handwara late on Thursday and were handed over to the families The bodies were buried here during the night after their last rites were performed by the families PTI SSB SMN SMN
