Chennai Apr 21 PTI The files relating to all seven convicts in former Prime Minister Rajiv Gandhi assassination case seeking their premature release had been forwarded by the then Tamil Nadu Governor to the President on January 27 2021 the Madras High Court was told on Thursday When the writ petition from Nalini Sriharan one of the seven convicts in the case and serving life imprisonment at the Special Prison for Women in Vellore seeking release even without the consent of the Governor came up for further hearing Advocate-General R Shanmugasundaram said this to the first bench of Chief Justice M N Bhandari and Justice D Bharatha Chakravarthy today This submission was in response to a query raised by the bench last week Presently Nalini was availing a months parole offered by the state government And the bench adjourned the matter till April 25 after directing the AG to ascertain whether Nalini was punished for the offences under the TADA Act The previous AIADMK cabinet in September 2018 had passed a resolution and forwarded its recommendation to the then Governor Banwarilal Purohit to order the premature release of all the seven life convicts under Article 161 of the Constitution As there was no response from the Governor Nalini and others had filed several petitions in the High Court for a direction to the Governor to consider their plea But they were all rejected by the High Court Hence Nalini filed the present writ petition praying the court to order her release even without the consent of the Governor The seven convicts serving life imprisonment are Murugan Santhan A G Perarivalan Jayakumar Robert Payas Ravichandran and Nalini Rajiv Gandhi was killed in a suicide bomb attack at Sriperumbudur near here in May 1991 PTI CORR SA SA

Chennai Mar 30 PTI The Madras High Court on Wednesday directed the Tamil Nadu government to ascertain and inform it as to whether the TN Governor had forwarded the 2018 state cabinet recommendations on release of all the seven convicts in former Prime Minister Rajiv Gandhi assassination to the President or selectively in respect of A G Perarivalan alone The first bench of Chief Justice M N Bhandari and Justice D Bharatha Chakravarthy gave a direction to this effect orally when Nalini Sriharans petition seeking the court to order her release even without the consent of the Governor came up for further hearing today Nalini is one of the seven convicts in the case the others being Murugan Santhan A G Perarivalan Robert Payas Ravichandran and Jayakumar The bench also wondered again as to how the High Court can entertain Nalinis plea This is so especially when her earlier pleas seeking a direction to the Governor to countersign the Cabinets recommendation were rejected repeatedly the bench added The previous AIADMK cabinet had in September 2018 passed a resolution and forwarded its recommendation to the then Governor Banwarilal Purohit to order the premature release of all the seven life convicts under 161 of the Constitution As there was nothing forthcoming from the Governors end Nalini and others had filed several petitions in the High Court for a direction to the Governor to consider their plea But no such order was passed and all the petitions had failed Finally Nalini filed the present writ petition praying the court to order her release even without the consent of the Governor Meanwhile the Supreme Court had granted bail to Perarivalan Hence Nalini prayed the High Court to apply the same yardstick adopted and grant her similar relief However the bench had said that the Apex Court is the supreme judicial body and that the High Court cannot decide on this issue on its own When the matter came up today the bench sought the clarification and adjourned the matter by a week PTI CORR SA SA

Chennai Dec 20 PTI The Tamil Nadu government was considering granting parole to Nalini Sriharan one of the seven life convicts in the Rajiv Gandhi assassination case the Madras High Court was informed on Monday State Public Prosecutor Mohammed Hassan Jinnah told this to the Division Bench of Justices P N Prakash and R Hemalatha when a petition from Padma mother of Nalini came up for further hearing today In her petition Padma had stated she was suffering from various illnesses and wanted her daughter to be by her bedside In this connection she had sent several representations to the State government to grant parole for one month to her daughter but to no avail Jinnah told the judges the plea was under the active consideration of the government and prayed them to grant some more time to apprise the court Granting three more days the judges posted the matter for December 23 Former Prime Minister Rajiv Gandhi was assassinated on May 21 1991 at Sriperumbudur near here by a suicide-bomber of the LTTE Seven people -- Murugan Santhan Perarivalan Jayakumar Robert Payas Ravichandran and Nalini -- are serving life term in connection with the assassination PTI SANVG NVG
