Mumbai Apr 21 PTI Those in respectable positions must refrain from making irresponsible comments against other public figures and instead set a good example before youngsters the Bombay High Court said on Thursday A bench led by Justice P B Varale was presiding over a plea filed by Union minister and BJP leader Narayan Rane seeking quashing of an FIR filed in Dhule district of Maharashtra against him for his remark against Chief Minister Uddhav Thackeray made last year The court also asked the Maharashtra government if the police were willing to make a statement that it will refrain from taking any coercive action against Rane Those in respectable post must refrain from making irresponsible comments against other public figuresWhy doesnt the petitioner Rane come forward in court and make a statement that let bygones be bygones Let us decide on being respectable to everyone Let us not give out a wrong signal to the people the high court said Let us give a good example to our youngsters Ultimately the state of Maharashtra is one that has a rich heritage it said In the past one of the senior most opposition leaders had brought a morcha to the mantralaya after which the then chief minister came out of his chambers took the leader along and gave him a personal hearing This was our rich heritage the high court added In August last year Rane had sparked off a row over his remarks about slapping Uddhav Thackeray for what he claimed as the latters ignorance of the year of Indias independence He was arrested and was later released on bail Rane had filed the plea through his counsel senior advocate Satish Maneshinde seeking that the Dhule FIR be quashed Maneshinde on Thursday told the high court that Rane had no intention to vilify anyone He said that an FIR had also been registered in Nashik against Rane over the same remark And the Nashik police had made a statement of not taking any coercive action against the minister until further orders of the high court The bench asked Maharashtra Advocate General Ashutosh Kumbhakoni to inform the court by Friday if the police were willing to make such statement that it will refrain from taking any coercive action against Rane Maneshinde sought that the present plea be tagged with the one filed earlier by Rane seeking quashing of the Nashik FIR There was a statement in that And you want this the statement to continue here while you apply for tagging HC asked Okay then you Maharashtra government ask AG if there is any harm if similar statement can be made in the present case it said PTI AYA NP NP

Mumbai Mar 22 PTI The Bombay High Court on Tuesday directed the Brihanmumbai Municipal Corporation to hear and decide an application filed by a company owned by Union Minister Narayan Rane seeking to regularise the alleged illegal alterations made in his bungalow in suburban Juhu A division bench of Justices Amjad Sayed and Abhay Ahuja said once a decision is taken by the civic body in case of any adverse order no coercive or punitive action shall be taken for a period of three weeks thereafter The court disposed of the petition filed by Kaalka Real Estate which owns the bungalow named Aadish Rane is a shareholder in the company along with his family members and resides in the house The petition had challenged notices issued by the BMC to the company Rane and his family against alleged unauthorised alterations made in the bungalow The petition also sought quashing of the BMC notices of February 25 March 4 and March 16 2022 and the orders passed by a designated officer of the civic body terming them as perverse illegal and in violation of his fundamental rights Senior counsel Milind Sathe appearing for the petitioner company argued on Tuesday that the BMC was not following the law in the present case and claimed there was no violation The said bungalow was granted an Occupation Certificate by the BMC in January 2013 It has been occupied since then Now suddenly in 2022 all this action has been taken Sathe said BMCs counsel Aspi Chinoy alleged that there have been several illegal alterations in the bungalow The court said if the regularisation application is filed then it should be heard and decided The Shiv Sena-controlled BMC had issued notices to Rane and the company directing them to remove the alterations made to the bungalow The civic body said if the alterations are not removed it would be compelled to demolish the same and recover charges from the owner The first notice was sent on February 25 in the name of the ownersoccupiers Rane and family to show cause how the alleged unauthorised additions changes in usage of the premises were not in contravention to the approved plans Narayan Ranes wife Neelam Rane and son Nilesh Rane responded to the notice alleging the malafide intention The reply stated that the notice had been issued after nine years of completion of the building Following this they were called for a hearing before a BMC officer Meanwhile a second notice was issued on March 4 Simultaneously the company also made an application for retention of portions of the premises alleged to be in contravention by making payment of Rs 8790 as stipulated by the BMC The petition said that in the application the company had clarified there was no contravention of any regulation and the entire premise was within the permissible FSI floor space index limit Despite this the BMCs designated officer passed an order based on the first notice directing the alleged unauthorised work to be removed from the premises within 15 days Thereafter the second scheduled hearing also took place and the second identical order was passed Aggrieved by the issuance of notices and orders passed by the BMC the company filed the present petition before the HC PTI SP GK GK

Mumbai Mar 20 PTI The Shiv Sena-controlled Brihanmumbai Municipal Corporation BMC has issued a fresh notice to Union minister Narayan Ranes family asking it to remove the unauthorised alterations at its Juhu bungalow within 15 days In the notice issued on March 16 to BJP leader Ranes wife and son the BMC said the corporation will demolish the changes and recover charges for the same from the owner if he failed to remove the unauthorised change of use works On February 21 a team of civic officials had inspected the bungalow named Adhish located in the upscale Juhu area for the alleged violation of CRZ Coastal Regulation Zone norms In their March 11 reply to the BMCs earlier notice the Rane familys representatives had dismissed the allegations and said the corporations action of issuing the notice was actuated purely by malice and political vendetta borne by the Shiv Sena against the family and the Union minister The BMC in its reply to the point said that the owner was expected to answer the notice as contemplated in law The insertion of posts political parties and alleging malafides cannot be an answer to the illegalities mentioned in the notice the civic body said The representatives said Rane has been a vocal critic of Chief Minister Uddhav Thackeray and the manner in which the Shiv Sena is functioning in the Maharashtra government and the civic body Moreover our patriarch Rane being a member of the Bharatiya Janata Party and serving as a Cabinet Minister much to the envy of other political leaders in Shiv Sena we are being targeted on a personal level they said The BMC said that the notice was issued by its officer under the Mumbai Municipal Corporation MMC Act 1888 and hence the question of control rivalry envy and targeting are irrelevant for the reply of the notice The representatives had also said that the Union minister had steadfastly brought to the attention of the state machinery various details and information regarding the deaths of actor Sushant Singh Rajput and the latters former manager Disha Salian They said the Supreme Court had directed a CBI probe into Rajputs death and all this has irked CM Thackeray and his party and to vent out their anger they ordered the civic body to initiate such action The BMC said the action was initiated based on a complaint The site was inspected illegalities were noticed and the owner was later asked to show cause of the same Therefore the inclusion of random persons and investigations and also attributing the notice to a dignitary unconnected with your illegalities cannot be an answer for the illegalities committed by you the BMC had said In the latest notice the BMC has said a personal hearing was also held on March 14 and that Ranes representatives did not answer on any issues to prove that the change of use was authorised You are hereby directed to remove the said unauthorised change of use works as mentioned in the above referred notice within 15 days from the date hereof failing which the unauthorised change of use works mentioned in the notice will be demolishedremoved departmentally at your risk and cost and the charges of the demolition will be recovered from you through assessment department the BMC said You shall further note that if you fail to comply you will be liable to prosecution under section 475 A of MMC Act the corporation said PTI ENM NP NP

Mumbai Feb 21 PTI A team of civic officials on Monday inspected a bungalow owned by Union minister Narayan Rane in the upscale Juhu area here for alleged violation of CRZ norms sources said Police security at the Adish bungalow was beefed up during the time of inspection which was conducted for over two hours in the presence of Rane they said Officials of the Brihanmumbai Municipal Corporation BMC along with some police personnel reached the premises around 11 am They also took some photographs and measurements examined various documents and held a discussion on it with Rane the sources said Before entering the bungalow which falls under the K-west civic ward in western suburbs the BMC team went to the Santacruz police station to get some security personnel along with them they said The K-west wards assistant municipal commissioner did not respond to calls or text messages for queries about the inspection Earlier a BMC team had visited the spot on Friday evening but returned without any action as no one from the Rane family was present at the bungalow Amid the ongoing war of words between the Shiv Sena and BJP the BMC had last week issued a notice to the bungalows owner for conducting an inspection and taking measurements of the premises The notice issued by the Sena-controlled BMC did not bear the owners name The civic body had issued the notice on the basis of a complaint filed by an activist about alleged violations of the Coastal Regulatory Zone CRZ norms and other rules during the construction of the the bungalow The notice had said the civic team will visit to inspect the said premises and to take measurements and photographs of the same and also asked the owner to be present along with the last approved plan or authentic documents of the structure Leaders of the Shiv Sena and the BJP have been sparring since some time and trading charges against each other PTI KK GK GK

Mumbai Aug 25 PTI A court at Mahad in Maharashtra while granting bail to Union Minister Narayan Rane said his arrest over his controversial remarks against Chief Minister Uddhav Thackeray was justified but his custodial interrogation was not necessary The order was passed by the court late Tuesday night and a detailed copy of it was made available on Wednesday Considering the reason for arrest and other reasons I found that the arrest is justified magistrate S S Patil said in the order The court noted that while a few sections under which Rane was booked were non-bailable they were not punishable with life or death Considering these factors no prejudice would be caused to the prosecution if the accused is released on bail the court said adding that the accused shall not commit a similar type of offence Rane was arrested on Tuesday afternoon from Ratnagiri district in Maharashtra following his remarks that he would have slapped Chief Minister Thackeray for what he claimed as the latters ignorance of the year of Indias independence The Union minister was produced before magistrate Patil at Mahad in Raigad on Tuesday night The police sought his custody for seven days which the court refused and remanded him to judicial custody till September 4 Ranes advocates then moved a bail application The plea was heard and Rane was granted bail on a surety of Rs 15000 He was directed to appear at the office of Superintendent of Police in Alibaug Raigad on August 30 and September 13 Ranes advocate Rajendra Shirodkar argued that the police had not followed the mandate of law laid down under Section 41A of the Code of Criminal Procedure CrPC which says in cases where arrest is not warranted the police ought to first issue a noticesummons to the accused for questioning However the court in its order noted that in this particular section there are grounds given when the police officer can arrest a person without noticesummons The magistrate while refusing to grant Ranes custody to the police noted that the alleged statement of the accused Rane was made before the media The informant complainant in the case himself alleged in the FIR that the accused made the statement before the media and it was viral on social media Considering the nature of the offence I do not find it necessary to hand over the accused in police custody the magistrate said in the order While arguing on Ranes bail plea Shirodkar told the court that the accused was a senior citizen with roots in the society and hence would not abscond He further told the court that he had advised his client Rane not to make such statements in public in future but Rane did not concede to such an undertaking quoting his liberty The police opposed the bail plea arguing that the accused was a Union cabinet minister and was making such irresponsible statements which would create disharmony in the society The court in its order directed Rane to cooperate with the probe into the case and if police want a voice sample of the minister then he Rane shall assist The only rider is that the police shall give seven-day prior notice to the accused it said The court also noted that the police had not followed directions given by the Bombay High Court with regard to maintaining a proper case diary Admittedly the case diary produced before me are two papers which are not paginated the magistrate said Rane faces four FIRs in Maharashtra over his remarks which triggered a political row and protests across the state on Tuesday The FIR at Mahad was registered under Indian Penal Code IPC Sections 189 threat of injury to public servant 504 intentional insult to provoke break of public peace and 505 statements conducive to public mischief PTI SP AVI GK GK
