Kochi Jan 31 PTI The police on Monday told the Kerala High Court that actor Dileep and others were not cooperating with the investigation in the FIR against them for allegedly threatening officials probing the sexual assault of an actress in 2017 while the actor claimed that the latest case was a manipulation Dileeps lawyers also hinted in the high court that they would probably be filing a case seeking a CBI probe into the whole matter which according to them has been turned into a media trial Senior advocate B Raman Pillai and advocate Philip T Varghese appearing for the actor also alleged that the fresh case against him was fabricated by the Crime Branch officers investigating the assault on the actress The contentions by both sides were made during the hearing of the anticipatory bail pleas moved by the actor his brother brother-in-law and others in the fresh case lodged against them The plea was vehemently opposed by Director General of Prosecution T A Shaji and additional public prosecutor P Narayanan who represented the police saying the conduct of the actor and the accused so far in the case does not entitle them to any leniency or discretionary relief from the court They claimed that the accused not only did not cooperate with the investigation they also tampered with the evidence as they sent their mobile phones to Mumbai under the pretext of forensic examination to sabotage the probe They also questioned how Dileep and the others can demand that the phones be examined at a facility of their choice What is so special about him that he is dictating terms of the probe They cannot be allowed to take the court and the law for a ride Let them surrender to the process of the law like any other accused they further contended The police also argued that they have been unable to unearth anything in the case due to the protective order Dileep and the others are enjoying since January 12 They also urged the court to handover to them the phones produced by the accused before the Registrar General of the high court as per its order of January 29 This was opposed by Dileeps lawyers who said that the phones may remain with the court for the time being They contended that the police were trying to get custody of the actor by whatever means possible and that the case was a manipulation After hearing both sides Justice Gopinath P listed the matter on Tuesday when he said he will decide what to do with regard to the mobile phones The court also said that it will hear the anticipatory bail pleas like that of any other accused The high court on January 29 had asked Dileep and others to produce before the Registrar General their mobile phones on a plea by the Crime Branch in a case against him and five others for allegedly threatening officials probing the sexual assault of an actress in 2017 On January 22 the court had granted interim protection to Dileep from arrest and had directed him and the others to appear before the investigating officers on January 23 24 and 25 for interrogation The accused were directed to fully cooperate with the investigation Prior to this the court had protected the actor and others from any coercive action on January 12 On January 9 the Crime Branch registered the case on a complaint filed by an investigating officer based on a purported audio clip of Dileep which was telecast by a TV channel in which the actor was allegedly heard conspiring to attack the official The actor and five others were booked under various provisions of the Indian Penal Code including Sections 116 abetment 118 concealing design to commit offence 120B criminal conspiracy 506 criminal intimidation and 34 criminal act done by several people The actress-victim who has worked in Tamil Telugu and Malayalam films was abducted and allegedly molested in her car for two hours by some of the accused who had forced their way into the vehicle on the night of February 17 2017 and later escaped in a busy area The entire act was filmed by some of the accused to blackmail the actress There are 10 accused in the case and police have arrested seven Dileep was arrested subsequently and released on bail PTI HMP BN BN

New Delhi Nov 22 PTI The CBI on Monday told the Supreme Court there may be a larger conspiracy involving foreign hands in the 1994 ISRO espionage case in which scientist Nambi Narayanan was allegedly framed by the Kerala police due to which the technology to develop the cryogenic engine was hit and the countrys space programme went back by at least one or two decades The Central Bureau of InvestigationCBI made the submission even as the top court agreed to hear its plea challenging the Kerala High Court order granting anticipatory bail to four persons including a former Director-General of Police DGP in connection with the ISRO espionage case The CBIs petition came up for hearing before a bench of Justices A M Khanwilkar and C T Ravikumar which issued notice and posted it for hearing on November 29 The high court on August 13 granted anticipatory bail to four accused-- a former Gujarat DGP R B Sreekumar two former Kerala police officers S Vijayan and Thampi S Durga Dutt and a retired intelligence official P S Jayaprakash Additional Solicitor General ASG S V Raju appearing for the CBI told the apex court that grant of anticipatory bail might derail the investigation in the case Raju said the CBI has found in its probe that some scientists were allegedly tortured and framed in the case due to which the development of the cryogenic engine was hit and this led to Indias space programme going back by almost one or two decades We CBI are proceeding on the line that the technology for the cryogenic engine was deliberately tried to be stalled by arresting the scientists who were involved in the development of the engine as a result of which our space programme went back by at least one or two decades Raju told the bench He said this is a very serious matter and there may be a larger conspiracy at the behest of foreign hands which is being investigated We are issuing notice the bench said As the bench said it was issuing notice on the plea the ASG said May I request a stay of the order Where is the question of stay We are issuing notice and taking it on November 29 the bench observed The investigating agency had earlier alleged that there was a clear indication that the accused were part of a team which had ulterior motives to torpedo the attempts of the Indian Space Research Organisation ISRO for manufacturing the cryogenic engine While granting anticipatory bail to these persons the high court had said There is not even a scintilla of evidence regarding the petitioners being influenced by any foreign power so as to induce them to hatch a conspiracy to falsely implicate the scientists of the ISRO with the intention to stall the activities of the ISRO with regard to the development of the cryogenic engine It had said unless there are specific materials regarding their involvement prima facie it cannot be said that they were acting against the interests of the country The CBI has registered a case against 18 persons for various alleged offences including criminal conspiracy in connection with the arrest and detention of Narayanan a former ISRO scientist in the espionage case The case which had hit the headlines in 1994 pertained to allegations of transfer of certain confidential documents on Indias space programme to foreign countries by two scientists and four others including two Maldivian women Narayanan who was given a clean chit by the CBI had earlier said that the Kerala police had fabricated the case and the technology he was accused to have stolen and sold in the 1994 case did not even exist at that time The CBI in its probe had claimed that the then top police officials in Kerala were responsible for Narayanans illegal arrest The apex court had on September 14 2018 appointed a three-member committee while directing the Kerala government to cough up Rs 50 lakh compensation for compelling Narayanan to undergo immense humiliation Terming the police action against the ex-scientist of the ISRO as a psycho-pathological treatment the apex court had in September 2018 said that his liberty and dignity basic to his human rights were jeopardised as he was taken into custody and eventually despite all the glory of the past was compelled to face cynical abhorrencePTI ABA RKS GSN GSN GSN

Thiruvananthapuram Sep 21 PTI Two Maldives nationals who were also arrested along with scientist Nambi Narayanan in the 1994 ISRO spy case have moved the CBI requesting it to place before the Supreme Court their claim for damages of Rs 2 crore from each of the 18 officers who are arrayed as accused in the conspiracy case being probed by the agency The two women -- Mariyam Rasheeda and Fousiya Hasan -- have made the request to CBI as the agency has registered a case against the 18 officers which includes Intelligence Bureau officials for various offences which include criminal conspiracy and kidnapping and fabrication of evidence under the IPC in connection with the arrest and detention of Narayanan in the 1994 espionage case The women have urged the agency to place their claim for damages before the apex court when it hears CBIs appeal against a Kerala High Court order granting anticipatory bail to four accused - former DGP of Gujarat two former police officers of Kerala and a retired intelligence official - in the conspiracy case being probed by the agency The agency in its appeal has sought cancellation of the anticipatory bail granted to the four accused by the high court on August 13 The high court while granting the relief to the accused had said There is not even a scintilla of evidence regarding the petitioners being influenced by any foreign power so as to induce them to hatch a conspiracy to falsely implicate the scientists of the ISRO with the intention to stall the activities of the ISRO with regard to the development of the cryogenic engine Advocate Prasad Gandhi who represented the two women in their pleas before the Kerala High Court and a Sessions Court in Thiruvananthapuram opposing grant of any relief to the accused in the conspiracy case told PTI that they have urged the CBI to place their claim for damages before the apex court when it hears the appeal Gandhi said that such a claim can only be raised by them through the agency and the women cannot directly approach the apex court for relief The women are seeking the damages for the mental and physical torture as well as monetary loss suffered by them during their more than three-year long incarceration in a prison here in the espionage case They have claimed that they were not spies and were falsely implicated in the matter after one of them -- Mariyam Rasheeda -- denied the advances of one of officers of the SIT which was investigating the espionage case back then The Supreme Court had on April 15 ordered that the report of the committee appointed by it on the role of erring police officials in the espionage case relating to Narayanan be given to the CBI and directed it to conduct further investigations into the issue The committee was appointed by the apex court to look into the allegations against the police officers in the spying case The espionage case pertained to allegations of transfer of certain confidential documents on the space programme of India to foreign countries by two scientists and four others including the two Maldivians The CBI in its probe at that time had held that top police officials in Kerala were responsible for Narayanans arrest which the agency said was illegal The case had a political fallout too with a section in the Congress party targeting the then Chief Minister K Karunakaran who is now dead over the issue that eventually led to his resignation PTI HMP SS SS
