New Delhi Nov 30 PTI The Supreme Court Tuesday dismissed a plea by students alleging discrepancy in a question in the Hindi version of Physics paper in NEET UG 2021 after the NTA-appointed expert panels finding said the answer would remain same in Hindi as well as EnglishA bench of Justices D Y Chandrachud A S Bopanna and Vikram Nath said it would be beyond the remit of the court to conduct an exercise of re-assessing the correctness of the solutionsIt said the National Testing Agency NTA entrusted with the duty of conducting the NEET UG 2021 examination while responding to the apprehensions of the students had the matter scrutinized again by three subject expertsHence it would not be open to this Court to substitute its own view In the circumstances having given our anxious consideration to the submission which has been urged on behalf of the petitioners we are unable to interfere The petition is accordingly dismissed it saidAdvocate Archana Pathak Dave appearing on behalf of the petitioners tried to persuade the top court that based on the underlying material in the 12th standard Board examination there would be a variation in the solutions to the question in English and Hindi as a result of a difference in translationAt the outset Solicitor General Tushar Mehta appearing for the NTA said that in compliance to the earlier order of the court the agency has constituted an expert panel comprising of three Professors from IIT Guwahati Delhi Technological University Delhi and National Physical Laboratory Delhi for evaluating the solutions in both the English and Hindi versions of Question No 2 of Section A in the Physics Paper of the NEET UG 2021 examinationHe said the panel found that irrespective of the medium English or Hindi the answer to the question will remain same and therefore it clarifies the issue at hand On November 25 the NTA had told the top court that to allay the apprehensions of students who appeared for the NEET UG 2021 exam it will appoint a committee of three experts to evaluate again the answers to an alleged error in Hindi version of Physics paperMehta appearing for NTA had said that the questions will be evaluated again by a committee of three expertsThe top court was hearing a plea filed by Wajda Tabassum and 21 other NEET candidates alleging discrepancy and patent error in question number 2 of the Hindi version of Physics paper in which the word amplitude of the current had been omittedMehta had said that the issue was examined by neutral experts and they have opined that the answer would be the same irrespective of the alleged discrepancy or omission of words in the Hindi translation of the question paperDave had said that due to the omission of the words another answer in the Hindi version is correctShe had stated that out of over 15 lakh students who appeared for the NEET-UG examination nearly two lakh students opted for the Hindi version and they would be in a disadvantageous position as there was negative marking for wrong answersThe plea has claimed that due to the alleged omission of the words in the Hindi version candidates who have attempted the question have arrived at a different answer than their English counterpartsIt has been said that both the incorrect and the correct answers were provided as options to the multiple-choice questions and the students alleging omission of the words have sought deletion of the said questionThey have also sought to declare the NEET-UG 2021 examination as erroneous and faulty as the NTA without taking cognizance of the error has released the answer key based on the answer to the English translation and has put the Hindi version candidates at the disadvantageous positionThe plea had sought deletion of disputed question from all the versions of the subject and declaration of fresh resultThe National Eligibility and Entrance Test-Under Graduate NEET-UG examination was held on September 12 2021 for MBBS and BDS courses in which over 15 lakh students have appeared It was conducted by the NTA and results were declared on November 1 PTI MNL SA

New Delhi Nov 23 PTI Coming to the aid of a disabled female student suffering from dysgraphia who was not granted an additional hour of compensatory time in NEET UG examination and her answer sheet was forcefully taken away the Supreme Court on Tuesday asked the National Testing Agency NTA to consider taking steps to rectify the injustice done to her within one weekDysgraphia causes impaired handwriting and demonstrates inconsistent handwriting poor spelling and spacing transcription difficulties and incoherenceThe top court said individual injustices originating in a wrongful denial of rights and entitlements prescribed under the law cannot be sent into oblivion on the ground that these are a necessary consequence of a competitive examinationA bench of Justices DY Chandrachud and AS Bopanna however refused to grant the relief to the student who has been diagnosed with a 40 per cent permanent disability for holding re-examination for the NEET UGThe appellant was wrongfully deprived of compensatory time of one hour while appearing for the NEET without any fault of her own despite her entitlements as a Person with Disabilities PwD and a Person with Benchmark Disability PwBD Accordingly the first respondent NTA is directed to consider what steps could be taken to rectify the injustice within a period of one week Further it shall take necessary consequential measures under intimation to the DGHS it saidIt said the steps taken by the NTA in furtherance of the courts direction must be communicated to the Registry of this Court by filing a status report within two weeksJustice Chandrachud who penned the verdict said It is no answer for an authority bound by the dicta of law and the Constitution to throw up its hands in despair instead of attempting to remedy the injustice which is caused to a student A judge cannot ignore that behind the statistics is a human face reflecting the aspirations joy and tears of a student and her familyThe bench noted the girl student has secured an All India Rank of 1721 out of 2684 candidates qualified in the PwD category and concerning Maharashtra she has secured rank 249 out of 390 candidates in the PwD categoryThe NTA has stated that approximately 154 lakh candidates appeared at the NEET UG 2021 on September 12 2021 for which the result was declared on November 1 2021 and the All India Rank was forwarded on November 9 2021 to the Union Ministry of Health and Family Welfare to conduct counselling for admissionThe bench said the NTA as an examining body was bound to scrupulously enforce the Guidelines for Written Examinations which provides for specific relaxationsThe appellant has suffered an injustice by a wrongful denial of these relaxations and a lack of remedy by this Court would cause irretrievable injustice to the life of the student The Rights of Persons With Disabilities RwPD Act 2016 prescribing beneficial provisions for persons with specified disabilities would have no meaning unless it is scrupulously enforced it saidIt added In our view the first respondent NTA cannot be allowed to simply get away when confronted with the situation in hand whereby injustice has been caused to a student by standing behind the situation of a large competitive examinationThe bench noted the NTAs submissions that in an examination of such large proportions where over 16 lakh students registered and over 15 lakh students appeared it would not be possible to undo the injustice which has been done to a single candidateThe first respondent NTA must remember that all authority under the law is subject to the responsibility and above all to a sense of accountability The first respondent is governed by the rule of law and by the constitutional requirement of observing fairness Behind the abstract number of 15 lakh students lie human lives that can be altered due to the inadvertent yet significant errors of the first respondent it saidThe bench said in the present case the student had sought a re-examination where she would be allowed compensatory time as mandated by the Guidelines for Written Examination and the NEET Bulletin 2021We are in agreement with the viewthat holding a fresh examination is neither practicable nor proper Holding a fresh examination will delay medical admissions and cause uncertainty and chaos To that extent the denial of the relief sought for conducting a fresh examination for the appellant is not disturbed it saidThe bench said This Court would eschew the course of dictating the manner in which the grievance should be rectified leaving it to the discretion of the testing agency which is entrusted with the overall responsibility of conducting the examinationIn the present case we are of the categorical view that the first respondent cannot shirk or abrogate its responsibility to rectify the injustice which has been caused to the appellantThe bench said for effective participation of the students with disabilities in the society which undoubtedly is the salutary object of the legislation the safeguards which are provided by the law must be duly enforced and any breach of entitlement must be answerable at lawResponsibility and power without accountability are an anathema to our Constitution it said adding the number of cases where such injustices take place maybe a few or more than that but it cannot New Delhi Oct 28 PTI The Supreme Court Thursday permitted the National Testing Agency to declare the National Eligibility Entrance Test NEET results for admission to undergraduate medical courses across the country saying that it cannot hold the results of over 16 lakh students A bench comprising Justices L Nageswara Rao Sanjiv Khanna and B R Gavai also stayed the Bombay High Courts recent order asking the NTA not to declare the NEET results and conduct re-examination for two aspirants whose question papers and OMR sheets had got mixed up at a centre in Maharashtra We stay the high court judgement The National Testing Agency can announce the results the bench said after taking note of the submissions of Solicitor General Tushar Mehta who represented the NTA We will decide what happens to the two students upon reopening after Diwali vacation In the meanwhile we issue notice and file a counter But we cannot hold the results of 16 lakh students the bench said In an unprecedented order the Bombay High Court on October 20 directed the NTA set up in 2018 for conducting NEET for admission to undergraduate medical courses to hold fresh exams for the two students and declare their results along with the main results of the test conducted on September 12 The high court had taken note of the fact that the test booklet and OMR sheet of two medical aspirants -- Vaishanavi Bhopali and Abhishek Shivaji got mixed up at the examination centre before the start of the test and ordered that they be given fresh opportunity to appear At the outset the law officer raised the issue of the high courts stay on the declaration of results and said that the NTA would act to rectify the confusion if any of the students whose question papers and OMR sheets got mixed The counsel for NEET aspirants Bhopali and Shivaji said the high court considered the problems faced by the students that they were given wrong answer sheet as the serial number of question papers were different and it has been accepted by the invigilators also Then questions were attempted in a hurry The only solution was leniency It was like a common order passed by the High Court the lawyer said They are bright students as they all got more than ninety per cent marks in the qualifying examination The invigilator has accepted that there was a mix up How can we leave students in lurch the bench asked Simultaneously the bench also observed that it cannot hold the results of over 16 lakh students and can decide the case of the two aspirants after Diwali vacation Earlier the NTA had sought urgent hearing of its appeal against the High Courts order saying that the declaration of the results were being halted due to the order of the high court The NTA in its appeal said that the NEET UG 2021 Examination for more than 16 lakh candidates has been conducted on September 12 and due to the high courts order it has not been able to declare their results even though the same is ready for declaration The delay in declaration of Result of NEET UG 2021 will affect and further delay the subsequent process of admission to Undergraduate Medical Courses ie MBBS BDS BAMS BSMS BUMS and BHMS Courses it said in the plea The two students said the invigilators started distributing the test booklet to all the students at the scheduled time 150 pm However while distributing the test booklets fell down As a result the test booklets and the OMR sheets therein fell down and got mixed up the plea said The high court besides ordering re-examination and staying the declaration of the results also directed that the NTA shall give 48 hrs clear notice to the Petitioners about the date of examination and the centre allotted to the Petitioners Making it clear that the order shall not be treated as a precedent the high court had also directed the NTA to issue the admit card or permission as is required for the purpose of appearing for the examination directed to be held in advance Respondent Nos 1 and 2 are advised to frame appropriate Rulesguidelines for providing remedial measures in case of such difficulties that may arise in similar situations in future keeping in mind the interest and future of such students the high court said The NEET Entrance Exam was conducted on September 12 for 1614777 candidates involving 3682 centres in 202 cities 9548 Centre Superintendents Deputy Superintendents 5615 Observers 269378 Invigilators and 220 City Co-ordinators the NTA said in the plea PTI SJK PKS SA
