Finally Anupama gets custody of her baby

Thiruvananthapuram Nov 24 PTI One year of waiting and weeks long tough legal battle protests and controversies came to an end as Anupama S Chandran finally held her baby boy in her arms soon after she stepped out of a court complex here along with her partner Ajith on a rainy Wednesday afternoon She got custody of the baby whom she last saw when the infant was three days old after a family court here this afternoon ordered that the child be handed over to his biological parents The child had been under the care and protection of his adoptive parents in Andhra Pradesh till last Sunday The development comes a day after the DNA tests on the baby Anupama and Ajith at the Rajiv Gandhi Centre for Biotechnology RGCB established the couple as the parents of the child Emerging from the court complex the family travelled by car to the site of Anupamas protest these last few days in front of the Kerala State Council for Child Welfare KSCCW headquarters here I got my child He is in the car I am very happy now I wish to spend time with my child she told reporters When the court began its proceedings at 230 pm the Child Welfare Committee CWC submitted before it the results of the DNA test During the one-and-a-half hour long proceedings held in the chamber of the judge the baby who was in the custody of CWC at the Nirmala Sishu Bhavan was produced before the court following its directive The court then directed that the baby be medically examined and after completing all legal formalities ordered the CWC to hand over the child to his mother The court had posted the matter for November 30 but it preponed the hearing to Wednesday after the government pleader appealed to hand over the baby to its parents at the earliest Anupama 22 and her partner Ajith had been protesting in front of the KSCCW office at Thycaud here for some days demanding to get their child back The womans allegation that her child was forcibly taken away from her by her father a local CPIM leader triggered a political controversy following which the government had ordered a departmental probe into the incident Anupama had accused her parents of forcibly taking away her new-born child from her soon after its birth a year ago and alleged that though she had complained about it to police several times since April but they were reluctant to register a case against her family members However the Peroorkkada police here said a case was registered against six people -- her parents sister sisters husband and two of his fathers friends -- and that the delay occurred as they were awaiting legal opinion PTI HMP TGB APR APR

Thiruvananthapuram Nov 23 PTI Anupama Chandran and her husband Ajith are biological parents of a baby whose adoption sparked off a row in Kerala according to a DNA test report of the couple and the infant DNA tests on the baby and the couple conducted at the Rajiv Gandhi Centre for Biotechnology RGCB yesterday have returned positive official sources said on Tuesday After being informed about the test result the couple went to the Nirmala Sishu Bhavan here under the Child Welfare Committee CWC to see the baby whom Anupama had last seen when he was just 3 days old When she came out of the child care home Anupama told reporters that she was happy her baby had been brought back but it was difficult for her to leave him there now after seeing him She also broke down while telling reporters that the child was fine and was being well looked after at the care home A visibly distressed and tearful Anupama then said that she will respond further after some time but as the reporters followed her to the vehicle she had arrived in she stopped and spoke to them again She said that she hoped the hearing in the Family Court would be advanced from the earlier date of November 30 and it would hopefully be taken up in the next couple of days Once the matter is taken up by the court I will get back my son soon she said Leader of Opposition in the state assembly V D Satheesan said the entire issue indicates that the CPIM in Kerala was obsolete He said the state government should clarify what action has been taken against those working in the CWC in connection with the alleged illegal abduction and adoption of Anupamas child What is going on in the Child Welfare Committee should be investigated as the adoption took place even as the mother was searching for her baby he said The one-year-old boy was in the foster care of a couple in Andhra Pradesh and was brought back here on Sunday On November 18 the CWC issued an order directing the Kerala State Council for Child Welfare KSCCW to bring the child back to Kerala A team led by KSCCW officials and comprising an escort of a Special Juvenile Police unit received the child from the adoptive parents in Andhra Pradesh on Saturday and brought him back to Kerala The team reached the Thiruvananthapuram airport on Sunday night Anupama 24 and her partner Ajith have been protesting in front of the KSCCW office at Thycaud here for some days demanding to get her baby back The womans allegation that her child was forcibly taken away from her by her father a local CPIM leader triggered a political controversy and the government had announced a departmental probe into the incident Anupama had accused her parents of forcibly taking away her new-born child from her soon after its birth a year ago and alleged that though she had complained about it to the police several times since April they were reluctant to register a case against her family members However the Peroorkkada police here has said a case was registered against six people -- her parents sister sisters husband and two of his fathers friends -- and that the delay happened as they were awaiting legal opinion A family court last month stayed the adoption process of the child and directed the police to submit a detailed report on the matter in a sealed cover PTI HMP TGB HMP SS SS

Thiruvananthapuram Oct 26 PTI The Kerala Assembly on Tuesday witnessed heated arguments and protests as the opposition UDF raised the issue of a ruling CPIM leader putting up his grand child for adoption without the knowledge of his daughter terming it as one of the most heinous honour crimes reported in the state Hitting hard at the Left government the Congress-led opposition alleged that the top leaders of the Marxist party and the entire government machinery were complicit in the crime and demanded a judicial probe into the incidentThey also questioned the present claim of the CPIM leadership that their stand was to get the mother her baby backIt was interesting to note that Revolutionary Marxist Party RMP leader and Vadakara legislator K K Rema an arch critic of the CPIM and Chief Minister Pinarayi Vijayan sought notice for the adjournment motion on behalf of the opposition In her hard-hitting speech Rema alleged that the police and the State Council for Child Welfare who should have acted in accordance with the law had committed serious lapses in the case under the influence of the complainant Anupama S Chandrans father a local committee member of the CPIM Vijayan who holds the home portfolio could stand only with his head down in front of the mothers and children of the state she saidAnupama and her child are the victims of one of the most heinous honour crimes Kerala has ever witnessedIt was as an honour crime executed collectively by the entire state machinery she saidNot just to Anupama but they have shown cruelty also to the couple which adopted the child without knowing all the background she saidIt was a shock to know that all the government system were in complicit in the crime along with the family The child welfare committee should be dissolved and a judicial probe should be conducted into the incident Rema saidMeanwhile the opposition members trooped to the well of the House and protested alleging that Speaker M B Rajesh did not gave enough time for the woman leader to complete her speech Leader of Opposition V D Satheesan said though the actions of the state-run Council was mysterious in connection with the incident the government was trying to whitewash their crimes and protect them instead of punishing the wrongdoers The Marxist party and its government who were always waxing eloquent about progressive ideologies had adopted a reactionary stand in the issue and intervened in it in the way an extreme right wing group would do he further charged However State Minister for Health and Woman and Child Welfare Veena George rejected the demand of the opposition to discuss the matter in the House suspending all other proceedings Rubbishing the charges she said the state-run panel had put up the child for adoption after fulfilling all mandatory legal proceedings The court proceedings should be completed for Anupama to get her baby back she said adding that the infant should be with its mother if she is ready to look after it The 24-year-old Anupama had accused her parents of having taken away her newborn child forcibly from her soon after its birth a year ago and alleged that though she had complained about it to the police several times since April they were reluctant to register a case against the family members However Peroorkkada police here has said a case was registered earlier this week against six people including her parents sister and husband and fathers two friends and said the delay happened as they were awaiting legal opinion A family court here on Monday stayed the adoption process of the child and directed the police to submit a detailed report in a sealed cover The matter was posted for further hearing on November 1 PTI LGK ROH ROH

Thiruvananthapuram Oct 25 PTI A family court on Monday stayed the adoption process of the child of Anupama S Chandran The child had been put up for adoption by her parents last year without her knowledge The court here directed the police to submit a detailed report in a sealed cover and posted the matter for further hearing on November 1 The decision of the court came after the Kerala government and the Child Welfare Committee took a stand favourable to the mother The court asked the government to also clarify whether the child was abandoned or given for adoption Meanwhile the child would remain with the adoptive parents On October 23 the State government decided to apprise the family court of the demand put forth by Anupama S Chandran daughter of a CPI M local committee member whose baby had been put up for adoption by her parents last year without her knowledge Meanwhile Anupama who had earlier protested in front of the State Secretariat seeking custody of her child told reporters that she was extremely happy about the court order I feel extremely happy I hope I will get my child soon It took a long time she said The child is currently in foster care The adopting parents register with the national-level central adoption and resources agency for adopting the child All these matters are monitored by the court Anupama had accused her parents of having taken away her newborn child forcibly from her soon after its birth a year ago and alleged that though she had complained about it to the police several times since April they were reluctant to register a case against the family members However Peroorkkada police here said a case was registered earlier this week against six people including her parents sister and husband and fathers two friends and said the delay happened as they were awaiting legal opinion PTI RRT NVG NVG

Thiruvananthapuram Oct 24 PTI Anupama S Chandran daughter of a CPI M local committee member whose baby had been put up for adoption by her parents last year without her knowledge on Sunday said she has no faith in the police probe into the matter a view which was also echoed by Leader of Opposition in the Kerala Assembly V D Satheesan Speaking to reporters she said the police told her that it has initiated investigation based on her complaint made in September but has not taken into consideration her complaints in April to the police as well as the Chief Minister In such a situation I do not have faith in the police investigation she said Meanwhile Satheesan at a press conference said neither the police nor the State government has been able to ensure that the woman gets her baby back Where has the baby gone She went to the Chief Minister various ministers the police and also the child welfare committee in April What did they all do for the last six months It is only now a police probe has been ordered he said The Left government has not been able to ensure that a mother gets her child back he further said Satheesan claimed that this incident and others where women have been assaulted in the State indicates that the government has not been able to ensure safety or justice to women On Saturday State Health Minister Veena George said the governments stand was that the child should be with the mother itself and the government has decided to intervene before the final adoption order The child is currently in foster care The adopting parents register with the national-level central adoption and resources agency for adopting the child All these matters are monitored by the court The final order is yet to come Its a complex process But our policy is that the child should be with the mother she told the media Anupama on Saturday staged a hunger strike before the State Secretariat demanding that her child be returned to her She has accused her parents of having taken away her newborn child forcibly from her soon after its birth a year ago and alleged that though she had complained about it to the police several times since April they were reluctant to register a case against the family members However Peroorkkada police here has said a case was registered earlier this week against six people including her parents sister and husband and fathers two friends and said the delay happened as they were awaiting legal opinion PTI HMP NVG NVG

Thiruvananthapuram Oct 22 PTI Days after a CPIM leader here was booked for kidnapping his grandchild the party on Friday asserted that it wants the affected woman to get her baby backHowever the ruling party said it has limitations in intervening into the matter as it involves legal implicationsSenior leader and party district secretary Anavoor Nagappan admitted that the issue was brought to his notice and the party leadership by Anupama S Chandran daughter of CPIM local committee member P S Jayachandran some time back The woman was told that the issue could not be sorted out at the party level and advised to go the legal way to get her baby back he told media here The mother should get her babythat is always the partys stand I have informed Anupama that the issue could not be sorted out at the party level and so we can not intervene I also offered her support if she goes the legal way Nagappan said He also said the 23-year-old woman had never come to meet him but only submitted a letter of complaint at his office and later spoke over the phone The senior leader also said he had talked to Anupamas father P S Jayachandran a local committee member of the party based on her complaint and advised him to give her the baby back But he had said he was unable to do so as the child was handed over to the state-run Child Welfare Centre and there were legal hurdles to reclaim the infant the leader added The partys explanation came days after Anupama a former leader of the Students Federation of India SFI a feeder organisation of the CPIM alleged that though she had submitted her complaint to the senior Marxist party leaders including Chief Minister Pinarayi Vijayan no one had helped her to get her baby back She had accused her parents of forcefully having taken away her new-born child from her soon after its birth a year ago and alleged that though she had lodged a complaint with the police several times since April they were reluctant to register a case against the family members However Peroorkkada police here had said that a case was registered earlier this week against six people including her parents sister and husband and fathers two friends and said the delay was happened as they were waiting for the legal opinion Multiple charges under IPC Section 343 wrongful confinement 361 kidnapping from wrongful guardianship 471 using as genuine a forged document and so on were imposed against the accused they said According to Anupamas complaint her parents did not like her relationship with Ajith who was also a youth federation leader of the Left party As the child was born out of wedlock they had forcefully taken away the boy child three days after she got discharged from the hospital post delivery She left home in April and has been living with Ajith since then she said Police however said her father Jayachandran admitted that the child was separated from his daughter by them but claimed during the interrogation that it was done with her consent According to the fathers statement the child was placed in the Ammathottil the electric cradle located in front of the state-run Child Welfare Centre at Thycaud here in October last year As per the rules of the centre when they receive a child in the cradle they would keep the baby with them for the next two months If no one comes forward to claim the child they would allow the public to adopt the infant The investigation is still going on to collect more details and trace the baby the police had added PTI LGK ROH ROH
