Delhi court stays FIR against doctor in medical negligence case

New Delhi Nov 25 PTI A Delhi court has stayed the registration of FIR against a Lok Nayak Hospital doctor here in a case related to alleged medical negligence in the treatment of a kidney of a patient in 2005 Additional Sessions Judge Charu Aggarwal in an interim order stayed the decision of the magisterial court directing registration of FIR against the doctor for alleged medical negligenceThe magistrate had passed the order on the complaint of Ravindra Nath Dubey alleging that Dr Yogesh Kumar Sarin who was the Head of Paediatrics at the Lok Nayak Hospital at that time conducted a nephrectomy on his son and removed his kidney without consentChallenging the order Sarin through criminal lawyer Namit Saxena argued that he took written consent from the complainant and was also exonerated in five inquiriesThe lawyer told the court that Sarin is a senior doctor in Lok Nayak Hospital for the last 16 years and various medical committees including Delhi Medical Council gave him a clean chit during that period The Sessions Judge in the November 23 order said Keeping in mind the reports of different Medical Boards including of Delhi Medical Council the impugned order is hereby stayed till further orders without prejudice to the rights and contentions of the parties on merits of the case During the proceedings Saxena argued that the doctor was falsely implicated and that the complainant was harassing him He also placed the reports of all committees by way of which clean chit was given to Sarin The advocate argued that the trial court while passing the impugned order on the complaint filed in 2016 did not appreciate the reports of different Medical Boards which observed that there was no medical negligence Meanwhile counsel for the complainant stated that the impugned order was passed after appreciating all the facts and circumstances of the case and therefore no ground for stay was made out The case will now be heard on November 30 PTI AAK RKS RKS

Delhi court drops criminal proceedings against lawyer for misbehaving

New Delhi Sep 28 PTI A Delhi court on Tuesday agreed to drop criminal proceedings against a lawyer who had allegedly misbehaved and argued in a high-pitched voice in the courtroom after he said that he respects the court and will continue to do so in the futureAdditional Sessions Judge Shivaji Anand dropped the proceedings to ensure that harmony is maintained between the Bar and Bench The advocate told the judge that he never had any intention to disrespect the Bench and the matter between him and the Public Prosecutor has been resolved amicablyHe further submitted that he always respected the courts and will continue to do so in the future the court noted in the orderRohini Court Bar Association President Inder Singh Saroha and other office bearers also requested the court to drop the proceedings in order to maintain harmony between the Bar and Bench It was also contended by the office bearers of the association that they will ensure that the dignity of the courts is maintained In view of submissions made before me and above reasons to ensure the harmony between the Bar and Bench the proceedings initiated vide order dated September 8 and 10 against advocate are dropped the judge orderedDuring a physical hearing on September 8 the lawyer allegedly kept arguing with a prosecutor in a very high pitch tone alleging that he is making a mockery of himDespite repeated warnings by the judge the lawyer continued to raise his voice impelling the judge to seek a written reply on why he misbehaved and interfered in the court proceedings even after his matter was overOn September 10 when the lawyer refused to submit the explanation despite being informed that his such stand may amount to an offence the judge directed for initiation of criminal proceedings PTI AAK RKS RKS

New Delhi Sep 28 PTI A Delhi court on Tuesday dismissed an application filed by Anirudh Dahiya one of the accused in the Chhatrasal Stadium murder case involving Olympic medallist wrestler Sushil Kumar seeking 13-day interim bail to appear for a college exam Additional Sessions Judge Shivaji Anand denied relief to the 23-year-old international wrestler after noting that he and the victims in the case are from the same fraternity and there is an apprehension of threat to Dahiyas life due to enmityThe judge also accepted the arguments of the prosecutor that Dahiya should have applied for appearing in the online examination on time The last day to apply for the online examination was September 24Keeping in view the fact that in the present case a large group of accused persons is involved and even the charge sheet against all the accused persons has not been filed In view of nature and gravity of the offence I do not find it a fit case for grant of interim bail the judge saidFurther the applicantaccused and victims are from the same fraternity and there is an apprehension of life of the present applicant also due to enmity the court added Dahiya had told the court that he has to physically appear for the fourth-semester exams for which he needs bail from September 27 to October 9 He claimed that he could not give his first and third-semester exams from jail earlier due to technical intricacies and administrative lapses During the course of the hearing Dahiyas counsel Himanshu Rana submitted that his client could only give exams in the offline mode as the date for applying for the option for giving exams through online mode has passed Please keep my future in mind Rana told the court To this advocate Nitin Vasishth appearing for the victim and complainant Sonu said If he was such a good student he should not have committed the crime This was the second time this month that the accused sought interim bail for the exam Earlier this month the court had dismissed his plea seeking interim bail for appearing in first and third semester exams but allowed him to take an online exam from the jailIn the fresh bail plea Dahiya had claimed that he has to appear in five examinations which are scheduled to take place from September 29 to October 6 and if he is not given time to prepare for them his whole future will be ruinedThe case in which he is accused relates to the alleged murder of former junior national wrestling champion Sagar Dhankar Sushil Kumar is the main accused in the caseKumar and Dahiya along with several others had allegedly assaulted Dhankar and his friends at the stadium on the intervening night of May 4 and 5 over an alleged property disputeDhankar succumbed to the injuries later According to the post-mortem report he died due to cerebral damage resulting from blunt object impact PTI AAK RKS RKS
