Court extends Maliks judicial custody till May 6 in property case linked to Dawood

Mumbai Apr 22 PTI A special court here on Friday extended till May 6 the judicial custody of Maharashtra Minister Nawab Malik in a money laundering probe linked to the activities of fugitive don Dawood Ibrahim and his aides The Enforcement Directorate ED had arrested Malik 62 a senior NCP leader on February 23 in the case registered under the Prevention of Money Laundering Act PMLA Malik was produced before special judge R N Rokade at the end of his previous jail custody on Friday The Central probe agency had on Thursday submitted an over 5000-page chargesheet against Malik in the case The EDs case is based on an FIR filed recently by the National Investigation Agency NIA against Ibrahim a designated global terrorist and key 1993 Mumbai bomb blasts accused and his aides under the Unlawful Activities Prevention Act UAPA The ED has claimed that Malik was actively involved in terror funding PTI AVI ARU ARU

Mumbai Mar 31 PTI A court here on Thursday allowed a CBI plea seeking its permission to take custody of former Maharashtra home minister Anil Deshmukh for investigation into a corruption case registered against him and others Deshmukh 71 a senior NCP leader and his two aides - Sanjeev Palande and Kundan Shinde - are currently in jail under judicial custody in a money laundering case being probed by the Enforcement Directorate ED The CBI on Thursday moved an application before additional sessions judge D P Singhade for making a request to the special PMLA court presiding over the money laundering case to transfer Deshmukh and his two aides to the custody of its investigating officer looking into the corruption caseA similar permission was also sought for dismissed police officer Sachin Waze another accused in the case Waze is in judicial custody after being arrested by the NIA in the Antila bomb scare-Mansukh Hiran murder caseJudge Singhade allowed the central probe agencys application and issued a letter of request to the courts concerned Former Mumbai police commissioner Param Bir Singh had last March alleged that Deshmukh then-home minister had given a target to police officers to collect Rs 100 crore per month from restaurants and bars in the metropolisDeshmukh has denied the allegationsThe CBI had lodged an FIR after conducting a preliminary enquiry against Deshmukh following an order of the Bombay High Court last April The NCP leader had resigned from the state cabinet after the HC order PTI AVI RSY RSY

Mumbai Nov 24 PTI A magistrate court here has asked the police to further investigate a case filed by a woman alleging she was harassed and stalked by some people at the behest of Shiv Sena MP Sanjay Raut and rejected an A-summary report filed by cops while pointing out loopholes in the probe according to an order made available on WednesdayChief metropolitan magistrate S B Bhajipale had rejected the summary report of the police on November 18 and a detailed order in the matter was made available nowAn A-summary report is a document where the police seek to close a probe in a case where they find that although an offence is made out there isnt enough evidence against the accusedThe magistrate in his order said the investigating officer miserably failed to take into account that prior to the alleged incident dated June 29 2013 earlier also on May 16 2013 a similar assault was made out on the complainantThe 39-year-old complainant herself provided the names of suspicious persons but the investing officer never examined them the order saidThe court noted it is a well settled principle that a first information report FIR is not an encyclopedia There are different factors which may compel some omissions in the FIRA vigilant investigating officer records supplementary statement of a complainant and verifies its truthfulness the magistrate notedHowever in the current case no attempt was made by the investigating officer to that effect the court observedIn such circumstances there is a scope for further investigation into the allegations of the woman complainant the court addedIn the past Raut has refuted the allegations of stalking and harassment PTI AVI RSY RSY

Mumbai Oct 27 PTI Merely because he was present on a cruise ship from where drugs were allegedly seized it can not be said that he was in conspiracy with the other accused the special NDPS Act court here has said while granting bail to Avin Sahu Sahu was arrested alongwith actor Shah Rukh Khans on Aryan and others after the Narcotics Control Bureau NCB raided a cruise ship off the Mumbai coast and allegedly seized drugs on October 2 The role attributed to Sahu was different from that attributed to Aryan special judge for cases under Narcotic Drugs and Psychotropic Substances NDPS Act V V Patil said The court granted bail to Manish Rajgaria and Sahu on Tuesday The detailed order on Sahus plea became available on Wednesday that on Rajgarias plea was yet to be made available Aryan Khans bail plea is being heard by the Bombay High Court after the special court refused him relief earlier As per the NCB Sahu and Rajgaria were among the guests on the cruise ship Special public prosecutor Advait Sethna had contended that all the arrested accused 20 until now were connected to each other and offenses under sections 28 and 29 punishment for abetment and criminal conspiracy of NDPS Act were clearly made out But Sahus lawyer Sana Raees Khanthe argued that her client had been falsely implicated The judge noted in the order that the NCB failed to produce any evidence to show that Sahu was in contact with the other accused He has not disclosed the name of any accused or peddlers he has no connection with drug peddlers the court said The prosecution failed to point out any circumstances to show the nexus of the applicant Sahu with any co-accused to prima facie make out the ingredients of the conspiracy the special court said Merely because applicant was present on the cruise he can not be said to be having acted in conspiracy with co-accused it added The prosecution had contended that the courts reasoning while rejecting the bail applications of Aryan Khan Arbaaz Merchant and Munmun Dhamecha holding that there was an element of conspiracy was applicable here too But the court disagreed There is no evidence against the present applicant in respect of conspiracy Therefore merely because bail applications of co-accused are rejected bail application of the present applicant can not be rejected by applying same analogy the judge said PTI AVI KRK KRK

Mumbai Sep 22 PTI There was no material to satisfy the ingredients of a criminal conspiracy noted a court while discharging Maharashtra cabinet minister Chhagan Bhujbals son Pankaj nephew Sameer and two others in a case of alleged cheating involving a group of flat buyers in Navi Mumbai The four were discharged by additional sessions judge HS Sathbai earlier this month but a detailed court order was made available on WednesdayThe 2015 case pertains to allegedly cheating flat buyers in a Navi Mumbai real estate project called Hexworld It was alleged that 2344 flats were sold and Rs 44 crore was collected from buyers but they were not given possession as the project got stuck A case of cheating and breach of trust and under relevant provisions of the Maharashtra Ownership Flats Act MOFA was registered against Pankaj and Sameer Bhujbal Devisha Infrastructure Pvt Ltd the company that had taken up the project and others in 2015 on a complaint submitted by a resident of Chembur a suburb of MumbaiPankaj and Sameer Bhujbal and the two other accused were directors of Devisha Infrastructure The judge in his order observed that from the materials of the charge-sheet prima facie it cannot be inferred that there was an intention on part of Devisha Infrastructure or its directors to cheat the informant complainant or any other flat purchaser There is no material to satisfy the ingredients of the offence of criminal conspiracy since there was no misrepresentation to any of the flat purchaser he added The court said from the materials on record at the most it can be said that there was a breach of contract between Devisha Infrastructure and the flat purchasers The court said lodging of an FIR by the informant prima facie appears to be an attempt to resolve a civil dispute by giving it colour of a criminal offence No fraudulent or dishonest intention at the time of accepting the booking amount from the customer is seen the judge addedThe court said the reason of obstruction of CIDCO to access road to the construction site and attachment of immovable property of Devisha Infrastructure by the Enforcement Directorate in 2015 were sufficient and proper reasons for not making further construction of the buildings and giving possession of flatsCity and Industrial Development Corporation CIDCO is a planning agency of the Maharashtra government that has designed and developed Navi MumbaiThe circumstances that prevented them the accused from giving possession of the flats on or before 2012 were beyond the control of the private firm and its directors the court saidAfter perusal of relevant papers and the charge-sheet it appears that as per the demand of 200 flat purchasers their booking amount has been refunded by Devisha Infrastructure the court said Furthermore there was a just and valid cause which prevented them from completing the project it said PTI AVI RSY RSY
