New Delhi Apr 26 PTI The Supreme Court is scheduled to hear on Wednesday a batch of pleas challenging the constitutional validity of the sedition lawA three-judge bench of Chief Justice N V Ramana and justices Surya Kant and Hima Kohli is likely to take up the matter for hearingConcerned over the enormous misuse of the colonial-era penal law on sedition the top court in April last year had asked the Centre why it was not repealing the provision used by the British to silence people like Mahatma Gandhi to suppress freedom movement Agreeing to examine the pleas filed by the Editors Guild of India and a former Major-General S G Vombatkere challenging the Constitutionality of Section 124A sedition in the IPC the apex court had said its main concern was the misuse of law leading to rise in number of casesThe non-bailable provision makes any speech or expression that brings or attempts to bring into hatred or contempt or excites or attempts to excite disaffection towards the government established by law in Indiaa criminal offence punishable with a maximum sentence of life imprisonment PTI PKS TIR TIR

New Delhi Feb 18 PTI The Supreme Court has upheld a Gujarat High Court order directing the state government to pay pensionary benefits to a man who retired after rendering more than 30 years of service A bench of Justices M R Shah and B V Nagarathna said the State cannot be permitted to take the benefit of its own wrongTo take the services continuously for 30 years and thereafter to contend that an employee who has rendered 30 years continuous service shall not be eligible for pension is nothing but unreasonable the bench saidThe top court said as a welfare State the State ought not to have taken such a standIn the present case the High Court has not committed any error in directing the State to pay pensionary benefits to the respondent who has retired after rendering more than 30 years service the bench said PTI PKS TIR TIR
