New Delhi Apr 18 PTI The CBI has taken over the probe into the case of coins worth Rs 11 crore going missing from the vaults of the SBI branch in Mehandipur Balaji in Rajasthan officials said on Monday State Bank of India SBI had approached the Rajasthan High Court seeking a CBI probe into the matter as the missing amount was higher than Rs 3 crore the threshold for seeking a probe by the agency On the high courts directions the CBI has taken over the FIR earlier registered by the Rajasthan Police The matter came to light after the SBI branch decided to carry out counting of money after a preliminary enquiry indicated discrepancy in the cash reserve at the bank A Jaipiur-based private vendor was roped in to carry out the counting of coins worth over Rs 13 crore according to branch account books The counting revealed that over Rs 11 crore worth of coins were missing from the branch Only 3000 coin bags carrying about Rs 2 crore could be accounted for and were transferred to the RBIs coin holding branch It is also alleged that the employees of the private vendor who was doing the counting were threatened in the night on August 10 2021 at the guesthouse where they were staying and were asked to refrain from the counting the FIR has alleged PTI ABS SMN

New Delhi Mar 27 PTI A plea has been filed in the Delhi High Court challenging the Central Information Commissions order dismissing an RTI appeal seeking the agenda of the Supreme Court collegium meeting on December 12 2018 when certain decisions were purportedly taken on elevation of judges to the apex court Justice Yashwant Varma is scheduled to hear the plea on Monday Petitioner and activist Anjali Bhardwaj in her petition filed in the high court through advocate Prashant Bhushan challenged the CICs December 16 2021 order by which her second appeal was dismissed and urged it to direct the authorities to disclose the available information sought in the February 26 2019 RTI application The petition said that on January 23 2019 Justice Madan B Lokur who was a part of the December 12 2018 collegium meeting and retired on December 30 2018 in an interview expressed his disappointment that the December 12 2018 collegium resolution was not uploaded on the Supreme Court website He is quoted as having said Once we take certain decisions they have to be uploaded I am disappointed that they were not In such circumstances in the interest of transparency in the process of appointments in the judiciary on February 26 2019 the petitioner through an RTI application to the CPIO of the Supreme Court sought copy of the agenda decisions and resolution of the collegium meeting held on December 12 2018 the plea said It is pertinent to mention that according to former Chief Justice of India Ranjan Gogois autobiography Justice for the Judge the names of Justice Pradeep Nandrajog the then Chief Justice of the Rajasthan High Court and Justice Rajendra Menon the then Chief Justice of the Delhi High Court had received the nod for the elevation to the Supreme Court in the collegium meeting on December 12 2018 The matter allegedly got leaked after which the issue was kept in abeyance by Justice Gogoi till January 2019 because of the winter break which started on December 15 2018 the book said In January 2019 a new collegium got constituted after the retirement of Justice Lokur The new collegium in its resolution on January 10 2019 did not clear the names of Justice Nandrajog and Justice Menon for elevation to the Supreme Court according to the book The petition has not mentioned judges whose names were allegedly cleared Initially Bhardwaj filed an RTI before the Supreme Court seeking copies of the agenda decisions taken and resolutions passed in the December 12 2018 meeting However the Supreme Court Central Public Information Officer refused to provide the information on grounds that were held to be not proper by the First Appellate Authority FAA and therefore are not relevant it said However while disposing the appeal against the denial by the CPIO the FAA held that in view of the subsequent collegium resolution of January 10 2019 it was clear that though certain decisions were taken in the collegium meeting of December 12 2018 the required consultations could not be completed therefore no resolution was formally passed and hence information asked for could not be supplied to the petitioner the petition said It added that in the second appeal the CIC also relied upon the January 10 2019 resolution and held that the agenda of the collegiums December 12 2018 meeting was clear from the subsequent resolution of January 10 2019 and the copy of the decision and the resolution of December 2018 did not exist on record in terms of Section 2 f of the RTI Act and therefore could not be supplied to the petitioner The petition sought setting aside of the CIC order on the ground that the petitioner has asked for a copy of the agenda of the collegium meeting of December 12 2018 and not a summary or reference thereof Therefore CIC has erred in holding that agenda was clear from subsequent resolution dated January 10 2019 and therefore need not be provided No exception provided under the Act has been taken or given as to why a copy of the agenda cannot be supplied to the petitioner it said The Supreme Court FAA order while citing relevant portion of the collegium resolution on January 10 2019 had said The Collegium comprising the Chief Justice of India and four senior-most Judges of the Supreme Court viz Justices Madan B Lokur A K Sikri S A Bobde and N V Ramana met on Wednesday 12th December 2018 to discuss the Agenda viz 1 to consider and recommend names for appointment as Judges in the Supreme Court and 2 to consider proposals for transfer of Chief Justices and Judges of High Courts The then Collegium on 12th December 2018 took certain decisions However the required consultation could not be undertaken and completed as the winter vacation of the Court intervened By the time the Court re-opened the composition of the Collegium underwent a change After extensive deliberations on 5th 6th January 2019 the newly constituted Collegium deemed it appropriate to have a fresh look at the matter and also New Delhi Sep 25 PTI Judges occupying the highest moral ground go a long way in building public confidence in the justice delivery system and the perception of common man about the credentials and background of a judicial officer is vital the Supreme Court has saidThe apex court said that post of a judicial officer at any level involves applying the most exacting standardsA bench of Justices K M Joseph and P S Narasimha observed this in a judgement delivered on a plea challenging the Rajasthan High Court verdict allowing a petition filed by a man against the decision which had found that he did not deserve to be appointed to the civil judges cadreThe top court said that the judges discharge one of the most important functions of the State that is resolution of disputes involving citizens and post of the civil judge or magistrate is of highest importance as the highest volume of litigation instituted in the country takes place at the lowest levelThe post of a judicial officer at any level of the hierarchy involves applying the most exacting standards This is for reasons which are obvious The incumbent of a judicial post discharges one of the most important functions of the State that is the resolution of disputes involving the people of the country Judges occupying the highest moral ground go a long way in building public confidence in the justice delivery system the bench said in its judgement delivered on September 16Referring to the facts of the case it noted that some FIRs were lodged earlier against the man and he was acquitted on the basis of compromiseThe bench said that in two of the FIRs final reports were filed and in the absence of an honourable acquittal the alleged involvement of an officer in criminal cases may undermine public faith in the systemIn two FIRs we notice that the matter progressed further and the investigating authorities filed chargesheets However it is true that the first respondent man stood acquitted The acquittal is certainly not on the basis that there was no evidence whatsoever against the first respondent We are unable to describe the acquittals as honourable or acquittals based on there being a complete absence of evidence it said while setting aside the high court verdictIt said the high court is duty bound to recommend the most suitable persons to occupy the post The post of a civil judge or a magistrate is of the highest importance notwithstanding the fact that in the pyramidical structure of the judiciary the civil judge or the magistrate is at the lowest rung it said adding Character cannot be understood as being limited to a mere certifying of the character by the competent authorityIt said not many of the cases finally reach the highest court and it is through the civil judge or magistrate that the common man has the greatest interfaceMost importantly the perception of the common man about the credentials and background of the judicial officer is vital We have only highlighted these aspects as a prelude to consider the facts of the case further it saidThe Rajasthan High Court Jodhpur had issued a notification in November 2013 inviting applications for filling up the post of civil judge junior division and the man had applied to the sameWhile allowing the plea filed by the high court through its registrar general the apex court noted in its verdict that when the matter was taken for verification the man had volunteered with the information with regard to his being implicated in certain criminal casesIn July 2015 the committee of the high court which was tasked by the chief justice to consider the case of 12 candidates including the man resolved to not recommend himAfter the matter was referred back to the committee regarding these candidates the panel again did not recommend the case of the man and later the full court accepted the sameThereafter the man had filed a petition in the high court which granted him liberty to file representation before the registrar of the Rajasthan High Court JodhpurLater the matter was again considered by the lower judiciary committee of the high court which resolved to reject his representationThe man then filed another petition before the high court which allowed it while noting that admittedly no criminal case was pending against him when the online application form was submitted by him for recruitment to the postThe high court had also noted that out of four cases lodged against him two cases were found to be false after investigation and in two other cases offences were of simple injuries in which compromise was arrived at between the parties and he was acquittedThe high court while noting that the man belonged to the Scheduled Caste category had referred to an apex court verdict and said that decision of the committee was not in consonance with the spirit of the judgment PTI ABA ABA TIR TIR
