New Delhi Feb 25 PTI The Supreme Court Friday said it would hear on March 11 the CBIs plea against the Kerala High Court order granting anticipatory bail to four persons including a former Director-General of Police DGP in a case about the alleged framing of scientist Nambi Narayanan in the 1994 ISRO espionage caseThe high court had on August 13 last year granted anticipatory bail to former Gujarat DGP R B Sreekumar two former police officers of Kerala -- S Vijayan and Thampi S Durga and a retired intelligence official P S Jayaprakash -- in connection with the caseSreekumar was then the Deputy Director of the Intelligence BureauSolicitor General Tushar Mehta told a bench of Justices A M Khanwilkar and C T Ravikumar that he needed some time as the Additional Solicitor General ASG S V Raju assisting the court in the matter is in some personal difficulty and some documents are still awaitedI need some time Mr Raju ASG is assisting your lordships There is some personal difficulty on his part and otherwise also some documents are awaited Mehta told the benchHe requested the apex court to post the matter after two weeksThe bench said the matter would be heard on March 11The CBI had earlier told the apex court that a grant of anticipatory bail might derail the investigation in the caseThe CBI had said that it has found in its probe that some scientists were tortured and framed in the matter due to which development of the cryogenic engine was hit and this led to Indias space programme going back by almost one or two decadesThe investigating agency had earlier alleged that there was a clear indication that the accused were part of a team which had ulterior motives to torpedo the attempts of the ISRO for manufacturing the cryogenic engineWhile granting anticipatory bail to these accused persons the high court had said There is not even a scintilla of evidence regarding the petitioners being influenced by any foreign power so as to induce them to hatch a conspiracy to falsely implicate the scientists of the ISRO with the intention to stall the activities of the ISRO with regard to the development of the cryogenic engine It had said unless there are specific materials regarding their involvement prima facie it cannot be said that they were acting against the interests of the country The CBI has registered a case against 18 persons for various alleged offences including criminal conspiracy in connection with the arrest and detention of former ISRO scientist Nambi Narayanan in the espionage caseThe case which had hit the headlines in 1994 pertained to allegations of transfer of certain confidential documents on Indias space programme to foreign countries by two scientists and four others including two Maldivian womenNarayanan who was given a clean chit by the CBI had earlier said that the Kerala police had fabricated the case and the technology he was accused to have stolen and sold in the 1994 case did not even exist at that time The CBI in its probe had said that the then top police officials in Kerala were responsible for Narayanans illegal arrestThe apex court had on September 14 2018 appointed a three-member committee while directing the Kerala government to cough up Rs 50 lakh compensation for compelling Narayanan to undergo immense humiliationTerming the police action against the ex-scientist of the Indian Space Research Organisation ISRO as a psycho-pathological treatment the apex court had in September 2018 said that his liberty and dignity basic to his human rights were jeopardised as he was taken into custody and eventually despite all the glory of the past was compelled to face cynical abhorrence PTI ABA ABA RKS RKS

New Delhi Feb 23 PTI The Supreme Court Wednesday said the practice of handing over pages after pages during the arguments must be discouraged as it is not a healthy practice and creates confusionIt is not a personal remark but it is a general observation for everyone The practice here has changed completely During the arguments pages after pages are being handed over as if this is a dustbin in which you are dropping papers a bench headed by Justice A M Khanwilkar saidThe bench also comprising Justices Dinesh Maheshwari and C T Ravikumar made this observation while hearing arguments on a batch of pleas concerning the interpretation of certain provisions of the Prevention of Money Laundering Act PMLAThe top court said such practice must be discouragedAgain we are repeating it is not a personal remark It is about the practice which is evolving here which must be discouraged This is not a healthy practice It is not assisting the court It is creating confusion the bench saidThe observation by the bench came when an advocate who was arguing in the matter referred to his noteDo you expect us to keep on adding the bench askedTo this the counsel said he is not giving any judgement apart from two which were not relied upon earlierThats not the point These loose paper handling is impossible for us when we work at home the bench observed adding And then paper is missed and review petitions are filedThe advocate said they dont want to stress the court with more papers in the matterSolicitor General Tushar Mehta had earlier told the bench that there are over 200 petitions in the matter and interim stays have been granted in several serious cases due to which investigation has been affectedSome of these petitions have challenged the validity of certain provisions of the PMLA PTI ABA SA

New Delhi Feb 22 PTI The Supreme Court Tuesday said it would hear tomorrow a plea seeking cancellation of offline board examinations for classes 10 and 12 to be conducted by the CBSE and several other boards this yearWithout completing the course how can examination be conducted a bench headed by Justice A M Khanwilkar orally observed after the counsel appearing for the petitioner said that although the COVID-19 situation has improved classes have not been completedThe bench also comprising Justices Dinesh Maheshwari and C T Ravikumar granted liberty to the counsel appearing for the petitioner to serve the advance copy of the plea to the standing counsel for concerned respondents including the Central Board of Secondary Education CBSEWe will list it tomorrow the bench saidThe plea filed by activist Anubha Shrivastava Sahai and others was mentioned before the apex court for urgent listingThe counsel appearing for the petitioners told the bench that the apex court had passed orders in 2020 and 2021 regarding class 10 and 12 board exams and this year also the same problem is thereLast year there was a scheme after your lordships intervention This year also we require some sort of solution otherwise this is going to drag he said adding that this will affect further admissions and future of students will be in perilThe bench asked the counsel whether the examinations have commenced or are yet to commenceThe counsel said that examination of the Madhya Pradesh board has commencedEven though the corona situation has improved the classes have not completed Unless the course is completed you should not conduct the examination This is going to delay further CBSE has not proposed any scheme he saidThe bench initially asked the counsel to serve advance copy of the plea to the standing counsel for the CBSEWhen the lawyer said he would try to serve advance copy of the petition to all the respondents the bench granted liberty to serve the standing counsel for the concerned respondentsThe plea has sought directions to the CBSE and other education boards which have proposed to hold board examinations for classes 10 and 12 in offline mode to devise alternate modes of assessmentThe CBSE has decided to conduct term two board exams for class 10 and class 12 from April 26On Monday the matter was mentioned for urgent listing before a bench headed by Chief Justice N V RamanaThe counsel had told the CJI-led bench that physical examination should not be conducted due to the pandemicThe bench had said that the matter would be listed before a bench headed by Justice KhanwilkarOn June 17 last year the top court had approved the assessment schemes of the Council for the Indian School Certificate Examinations CISCE and the CBSE which had adopted the 303040 formula for evaluation of marks for students of 12th standard based on results of class 10 11 and 12 respectivelyThe CBSE had said it would evaluate class 12 students for theory based on 30 per cent marks from class 10 board 30 per cent from class 11 and 40 per cent from marks based on the performance in the unit mid-term and pre-board tests in class 12It had said that marks obtained by class 12 students in practical and internal assessment on an actual basis as uploaded by schools on the CBSE portal would be also considered in deciding the final results PTI ABA SA
