SC judge seeks more action by govt to make India global commercial arbitration hub

Ahmedabad Apr 23 PTI The government and all the stakeholders need to do more to make India a hub of international commercial arbitration and it is also essential that the arbitration law is aligned with the contemporary practice speakers at a seminar including Supreme Court judges Justice Bela Trivedi and Justice MR Shah said here on Saturday Speaking at the inaugural session of a seminar on international commercial arbitration Justice Trivedi rued that despite an effective dispute resolution process arbitration is being hampered by delays high costs frequent and sometimes unwarranted judicial interruptions at different stages Solicitor General of India Tushar Mehta suggested an arbitration township with the countrys framework that need not be specific to any model but acceptable to the world community Justice Trivedi also called for the removal of shortcomings and lacuna in implementing and operating the law on arbitration at the earliest to achieve the desired result Justice MR Shah said that the international market is not yet accepting the Indian institution for commercial arbitration and underlined the need for a change in the attitude and also introspection by stakeholders as to where they are missing and failing Referring to Justice BN Srikrishna retd Committee constituted by the Union Ministry of Law and Justice to review the institutionalisation of arbitration mechanism and suggest reforms Justice Trivedi said while it made several recommendations some of the amendments have not yet come into force The committee made several important recommendations but I was just telling Tusharbhai Mehta Solicitor General of India that some of the amendments have still not come into force and the government has not notified like an arbitration commission she said Justice Trivedi said though the government is committed it needs to do more in this regard If we want to make India the hub of international commercial arbitration all stakeholders will have to put their heads together and walk an extra mile According to me any system or any mechanism to succeed needs proper statutory backing and also the commitment and accountability of the people who run the institution she said Justice Trivedi also called for the need to remove shortcomings and lacuna in implementing and operating the Arbitration and Conciliation Act effectively Sometimes I wonder whether arbitration failed in India or has India failed arbitration There are many challenges to the implementation of the Act effectively When we are here to find a way forward we must look back and find out the pitfalls and drawbacks of our system which have failed us to maintain the pace with our counterparts in the world she said Speaking on the occasion Justice Shah said that with India being a promising destination for foreign investment it is essential that its arbitration law is aligned with the contemporary practice Unfortunately the international market is not accepting Indian institutions and the system as a whole he said We have to change our attitude We have to accept we have to think where are we lacking where are we missing where are we failing so that we do not match with their standards Justice Shah said Solicitor General of India Mehta suggested an arbitration township with the countrys framework that need not be specific to any model but acceptable to the world community We can provide for a township at a place where people would like to come We can provide an arbitration model which takes the best of both or all the systems of arbitration prevailing in the world he said Gujarat High Court Chief Justice Aravind Kumar said there is a paradigm shift in India and across the globe from ad hoc to institutionalised arbitration PTI KA NSK NSK

New Delhi Apr 18 PTI Muslim body Jamiat Ulama-i-Hind has moved the Supreme Court seeking a direction to the Centre and some states including Madhya Pradesh and Uttar Pradesh that precipitative actions like razing buildings in criminal proceedings be not taken The plea assumes significance because of recent actions taken by authorities in Madhya Pradesh to use bulldozers to raze properties of those accused of rioting during the Ram Navami celebrations Jamiat Ulama-I-Hind in its petition said the action like razing the house in a criminal proceeding as a punishment is unknown to criminal law Petitioners also seek a declaration that residential accommodations or any commercial property cannot be demolished as a punitive measure also pray that police personnel to be provided specialised training in handling communal riots and situations where populations become restive it said It is further prayed that directions be issued for Ministers Legislators and anybody unconnected with the criminal investigation to be restrained from apportioning criminal responsibility regarding criminal action publicly or through any official communication until a determination by a criminal court it said The plea alleged that several ministers and legislators have made statements about the guilt of a certain section of the society Referring to similar actions undertaken by states in Gujarat and Uttar Pradesh it said these undermine the criminal justice system of our country including the important role of the courts The legal process including the pre-trial and trial stage is hindered by these acts of the state therefore immediate action is needed to prevent such incidents from repeating The states wherein such measures are being employed by the administrative authorities have been carrying them out with impunity as they are being supported by the top leadership in the said states Hence this Court must step in to stop the situation from escalating any further and also prevent such acts from being repeated in other states as well The plea said Punitive actions at the outset as punishment are being inflicted without giving them an opportunity of hearing it said The petition has been filed by Gulzar Ahmed Noor Mohammed Azmi the Secretary of the Jamiat Ulama-i-Hind said Fazlur Rahman Qasmi the press secretary of the Muslim body PTI SJK RKS RKS

Jammu Mar 30 PTI Jammu and Kashmir Director General of Police Dilbag Singh on Wednesday chaired a meeting of senior officers here and stressed for adopting new initiatives and technologies in counter-terrorism operations and other security matters He also directed for increasing usage of various modules of the Inter-Operable Criminal Justice System ICJS for investigation and crime prevention a police spokesman said The meeting at the police headquarters here was convened to discuss the follow up of the recommendations of Director Generals of Police and Inspector Generals of Police Conference 2021 and their implementation by various wings and zones of J-K Police he said While discussing the installation of CCTV cameras and other technology-driven policing aids the DGP stressed for mission mode work on adopting new initiatives and technologies in counter-terrorism operations crimes and other security matters Singh directed the officers for developing the system to harness benefits of technical infrastructure put in place With regard to Emergency Response Support System ERSS he directed the nodal officers to take all the necessary initiatives to ensure integration of remaining helpline emergency numbers of different departments with ERSS setup as soon as possible He also directed to carry out the detailed analysis of all important police related incidents and develop them into case studies for making it an institutionalised learning mechanism saying it will help in shaping the future policing The DGP stressed for submitting regular updates of the elements involved in crimes of special nature He directed senior wing heads for preparing detailed reports on different policing issues so that implementation of the recommendations of the conference is ensured in a time-bound manner the spokesman said Referring to the community policing Singh emphasised on organising increased police-public meetings to further strengthen the ties with the people He directed for organising sports competitions including adventure sports events in border villages to engage youth in positive activities the spokesman said PTI TAS TAS AQS AQS

The Under-Secretary-General for Peace Operations told the Security Council on Wednesday that he was encouraged by a thaw in relations between South Sudan and Sudan, now that both have established national committees on the question of Abyei, the disputed oil-rich border territory claimed by both countries.  
“The warming of their relations was visible in Abyei, where most of the threats to the community were of a criminal nature, not of military nature”, Jean-Pierre Lacroix briefed Council Members.   The area was accorded special administrative status in 2004, and a UN Interim Security Force, , operates there to provide support for local policing, and the deployment of armed forces, in accordance with a 2011 Agreement. 

Sudan coup: ‘To early to know’ 

Referring to this week’s  in Sudan, he said that “it is too early to know what the impact of this week’s developments in Khartoum will mean” for the region and the Interim Security Force.  “But I am hopeful as I know that all parties in Sudan are, and have been, strong supporters of the Mission”, he added.  

Future of the mission 

UNISFA was established in 2011. In a , earlier this year, the asked for a possible drawdown and exit strategy.  Following that request, Mr. Lacroix presented a , which indicated that UNISFA was successfully continuing its work, to protect the people of Abyei through its military and mine action presence.   In the reporting period, from 16 April 2021 to 15 October 2021, the mission’s humanitarian and recovery work reached more than 103,000 vulnerable people.    Most of the new challenges during this period were related to the mandate of the Joint Border Verification and Monitoring Mechanism (JBVMM).  “Representatives of the community in Gok Machar made it difficult, and eventually impossible, for UNISFA to continue to support the implementation of the JBVMM mandate to a large extent”, Mr. Lacroix informed.  According to him, the review team identified an important space for UN peacebuilding, humanitarian, recovery and development assistance.    “It is my hope that the Council will provide UNISFA with a continued, and somewhat strengthened, mandate in this particular area, while slowly but steadily identifying areas where the military and security side of the Mission could start preparing for an eventual drawdown”, he said.   With respect to the military side, the strategic review proposes two options: keep overall force numbers close to what they are currently, or a lightly reduced troop ceiling.   

A positive trend 

Parfait Onanga-Anyanga, the Secretary-General , also briefed Council Members on the region, and relations between Sudan and South Sudan.   He noted that most of what he was reporting “may sound a bit removed from the unfolding situation in Sudan which could potentially negatively impact bilateral relations”, but also hoped that “the recent positive trend will not be derailed.”  He said the two countries have been deepening their relationship, pointing out several high-level visits and initiatives in support of each other’s peace processes.   For the Special Envoy, a newly agreed deal to resume export and border trade is a crucial step, but has so far not materialized, having been overtaken by the unfolding events in Sudan.  Regarding Abyei, he said “the long-standing deadlock has hindered any progress, besides leaving the area with a clearly defined status that has continued to stoke instability.”  The Special Representative also highlighted the high-level committees that both countries established, informing that they are currently both reviewing all past agreements.  The goal is to have negotiations, facilitated by a third party, that would lead to the settlement of the final status of the region.
