New Delhi Mar 21 PTI Infrastructure cost incurred in the mining of cryptocurrencies or any virtual digital assets will not be allowed as deduction under the Income Tax Act Minister of State for Finance Pankaj Chaudhary said on MondayIn a written reply to the Lok Sabha Chaudhary said the government will come out with a definition of Virtual Digital Assets VDA with a view to levy 30 per cent tax on income from the transfer of such assetsAlso loss from the transfer of VDA will not be allowed to be set off against the income arising from the transfer of another VDA Chaudhary saidHe also said that currently cryptocurrencies are unregulated in IndiaThe 2022-23 Budget has brought in clarity concerning the levy of income tax on crypto assets From April 1 a 30 per cent I-T plus cess and surcharges will be levied on such transactions in the same manner as it treats winnings from horse races or other speculative transactionsThe minister said that while computing the income from transfer of VDA no deduction in respect of any expenditure other than the cost of acquisition or allowance is allowedThe Finance Bill also proposes to define VDA If any asset falls within the proposed definition such virtual asset will be considered as VDA for the purposes of the Act and other provisions of the Act will apply accordingly he saidFurther he said infrastructure costs incurred in the mining of VDA eg crypto assets will not be treated as cost of acquisition as the same will be in the nature of capital expenditure which is not allowable as a deduction under the I-T ActNangia Andersen LLP Partner Sandeep Jhunjhunwala said since intra-head adjustment of losses ie set-off of loss arising from one VDA with the income from another VDA would not be permitted such losses would be a sunk cost for the investors causing a double whammy paying taxes on gains and no offset of lossesThis would lead to a situation where losses say on account of transaction in altcoins one VDA class would not be permitted for set-off against gains on another VDA class say any other programmable token or bitcoin he saidDisallowance of infrastructure cost incurred in mining cryptocurrencies costs as a permissible revenue expenditure would further increase the cost of mining these assets Jhunjhunwala addedRohinton Sidhwa Partner Deloitte India said the mining expense disallowance is unlikely to impact the majority of traders however the prevention of offset between different cryptos will probably negatively impact many tradersThe Budget 2022-23 also proposed a 1 per cent TDS on payments towards virtual currencies beyond Rs 10000 in a year and taxation of such gifts in the hands of the recipient The threshold limit for TDS would be Rs 50000 a year for specified persons which include individualsHUFs who are required to get their accounts audited under the I-T ActThe provisions related to 1 per cent TDS will come into effect from July 1 2022 while the gains will be taxed effective April 1Separately the government is working on a legislation to regulate cryptocurrencies but no draft has yet been released publicly PTI JD CS MBI RAM

Kolkata Feb 23 PTI The West Bengal government Wednesday began disbursal of compensation to consenting landowners in Deocha Pachami coal mining project area in Birbhum district and Chief Minister Mamata Banerjee personally handed over compensation cheques and job appointment letters to six families concerned Banerjee told reporters after the programme at the state secretriat that 1600 of the about 4200 odd families in the area have already given their consent to give their land for the Rs 30000 crore coal project She said that the state has firmed up a relief and rehabilitation package of Rs 10000 crore for the land losers of Deocha Pachami coal block considered the largest in the country and ranks second globally and no land owner who has consented to give hisher land will be deprived Over a lakh employment will be generated once the project gets underway Apart from the compensation from the land which is very exciting considering the market rate we will be handing over job appointment letters to all families who have given their land she said The chief minister said that compensation and support is being offered to even those who live in the area identified for the coal block and do not have any legal right either on any land or building there The Relief and Rehabilitation package offers double the market value of the land along with 100 per cent as solatium as land cost to a consenting landowner It has increased the built-up area of individual houses to be provided to all the families in model RR colonies to 700 sq ft from 600 sq ft The compensation in lieu of built up house has been increased from Rs five lakh per family to Rs seven lakh Subsistence allowance for each family has been increased to Rs 15 lakh from Rs one lakh While the original package provided for one employment for one member of every family as junior police constable in the revised package those with higher qualification will be given higher grade posting in police or an equivalent posting in other departments There are 12 villages in the area having around 4314 households with a population of 21033 A total 3601 of them are SCs and another 9034 STs Located in Muhammad bazar in Birbhum district Deocha Pachami is spread over 1231 sq km which is around 3400 acres Of the total area the government owns 100 acres of which 300 acres is forest land The block has a reserve of around 1198 million tonnes of coal and 1400 million cubic meter basalt black stone PTI BSM SUS KK KK KK

Kolkata Feb 21 PTI West Bengal Chief Minister Mamata Banerjee on Monday said the government has modified the compensation for land losers of Deocha Pachami coal mining project and that there will be no forced acquisition of land for it The Rs 35000 crore coal project in Birbhum district is the coutrys largest and the worlds second largest one Banerjee said after a cabinet meeting that the state government wants to acquire land for the mining project which will create one lakh jobs The government will develop this project and no land will be given to the private sector We have modified the compensation in the cabinet meeting so that people are benefitted Despite this if anyone does not want to give land we will not force and will develop the project excluding that portion she said The chief minister said that compensation and support is being offered to even those who live in the area identified for the coal block and do not have any legal right either on any land or building there Some illegal mine owners in the area are misguiding the locals but the offer is excellent and I dont think anyone will reject it The project will bring immense economic boost to the state by offering low cost power for another 100 years Banerjee who had supported the anti-land acquisition movements at Singur and Nandigram said Chief secretary H K Dwivedi said the government is offering rehabilitation package of Rs 10000 crore and has raised the compensation to be given for house building to Rs seven lakh from Rs five lakh and the size of houses to be given to them has been revised to 700 sq ft from 600 sq ft The government has also increased another component of the compensation from Rs one lakh to Rs 15 lakh he said It is paying two per cent compensation to land losers 100 per cent as solatium Rs 1 lakh as shifting cost Dwivedi said Better jobs like that of constables or group C employees will be given to qualified members of land loser families Dwivedi said There are 12 villages in the area having around 4314 households with a population of 21033 A total 3601 of them are SCs and another 9034 STs Located in Muhammad bazar in Birbhum district Deocha Pachami is spread over 1231 sq km which is around 3400 acres Of the total area the government owns 100 acres of which 300 acres is forest land The block has a reserve of around 1198 million tonnes of coal and 1400 million cubic meter basalt black stone PTI BSM KK KK KK

Raipur Nov 19 PTI Chhattisgarh Chief Minister Bhupesh Baghel on Friday made several announcements related to panchayat bodies including a hike in honorarium Addressing the state level Panchayati Raj Convention here Baghel said the honorarium given to the sarpanch will be increased from Rs 2000 to Rs 4000 while the hike will be from Rs 15000 to Rs 25000 for zilla parishad presidents The honorarium of zila panchayat vice president and members will be hiked from Rs 10000 to Rs 15000 and Rs 6000 to Rs10000 respectively The sarpanch will now be entitled to get the works done worth Rs 50 lakh while for public welfare works ZP presidents will get Rs 15 lakh per year vice presidents will get Rs 10 lakh members will get Rs 4 lakh he said The janpad panchayat president will get Rs 5 lakh per year janpad panchayat vice president Rs 3 lakh and janpad panchayat members Rs 2 lakh he added The note sheets seeking approval for implementation of the state budget schemes run by the Panchayat and Rural Development Department would be submitted to the president of concerned the zila panchayat and janpad panchayat he said adding that this provision will not be applicable for central government schemes PTI COR BNM BNM BNM

New Delhi Nov 17 PTI A fintech company engaged in giving instant loans through a mobile app has been found to have repatriated Rs 500 crore non-genuine funds overseas the CBDT said on WednesdayThe information was gathered by the Income Tax Department after it raided the company in Delhi and Gurgaon Haryana on November 9During the search it was revealed that the company has been allegedly charging very high processing fee at the time of disbursement of loansThis results into effective higher burden of compensation on the borrowers the Central Board of Direct Taxes CBDT said in a statementIt said the company is held by a group based in Cayman Island ultimately controlled by an individual of a neighbouring country The company has brought in India nominal initial capital by way of Foreign Direct Investment FDI but took substantial working capital loans from Indian banksThe business model of the company results in high rotation of capital which is evidenced by turnover of Rs 10000 crore in its first year of operation it said The CBDT which frames policy for the department said it was found that the company repatriated about Rs 500 crore to its overseas group companies under the pretext of buying of services in two years However evidence gathered during the search has revealed that such remittances made to the group companies are either highly inflated or non-genuine Evidences found also indicate that internal web-based application for lending business was controlled from outside India it saidThe department also recorded statements of key persons including foreign nationals PTI NES KJ

Chennai Oct 17 PTI A catalogue a purported annexure of an official circular listing 61 specific sources that are exploited by a section of police personnel to demand bribe has surfaced in the social media with the BJP demanding to know if corruption has increased in police department with the DMK assuming power in Tamil Nadu The annexure lists bribe money ranging from Rs 100 to as high as Rs 1 lakh and this is believed to be the rate per month in case of lodges and others and for other category of people this is a one time demand for services like issuance of a No Objection Certificate or for providing a copy of FIR The bribe is demanded mainly to allow illegal activities like smuggling including sand and for permitting gambling banned lottery and so on The circular from the Tamil Nadu state police headquarters here to officials in districts has ordered stern action against such tainted elements The district level officials and those in the jurisdiction of police ranges have forwarded the missive to others like deputy police superintendents working under them Police sources however neither denied nor confirmed the issuance or receipt of the annexure that listed specific rates demanded by writers in police stations sub-inspectors inspectors special branch personnel and those deployed in patrol duties including on the highways An official told PTI circulars mandating action against corrupt personnel are nothing new and our tough action against such elements is in the public domain He declined to comment on the purported annexure that listed the rates According to the annexure tainted police inspectors demand anywhere between Rs 10000 and Rs 1 lakh for civil disputes up to Rs 5000 from ganja sellers and about Rs 1 lakh from those involved in sale of banned lottery They also seek Rs 10000 to Rs 50000 from godowns storing gunpowder and for enquiry on current papers From lodges they collect Rs 2000 from a spa Rs 5000 dhaba hotels Rs 3000-Rs 7000 and from those running bars without permission Rs 2000 From granite quarries Rs 10000 and from sand smugglers Rs 20000 Corrupt station writers demand Rs 500 to Rs 1000 for issuing police NOC Rs 1000 for enquiry on landmoney dispute etc and Rs 100 to issue FIR copyTainted sub-inspectors demand Rs 5000 to Rs 20000 for civil disputes take up to Rs 5000 from those indulging in illegal sale of banned lottery and so onErrant elements in patrol duty take take anywhere from Rs 100 to Rs 500 for violation of Motor Vehicle Act norms and up to Rs 1000 for drunk driving The annexure goes on to list the price tag of tainted personnel in special branch as well and it includes a demand of up to Rs 2000 for bars both with and without licences Tamil Nadu unit president of the BJP K Annamalai appreciated the transparent effort to eliminate corruption and tagged the annexure as wellThe Saffron party leader however wondered what would be the response of Chief Minister M K Stalin who held the Home portfolio Has corruption increased in TN police department With the DMK taking over the reins of power he tweeted The annexure initially leaked to some people including journalists in western Tamil Nadu became available to media personnel in other places and was later shared by some people in the social media Over the years such lists of specific rates for particular services rendered by tainted police personnel and most sought after police stations eyeing big-ticket bribes have appeared in Tamil Nadu in both the English and the vernacular media PTI VGN SS SS

Mumbai Aug 25 PTI Admitting that family pension for bank employees is at a paltry level the government on Wednesday announced to raise the same to 30 per cent of the last-drawn salary Earlier kin of a deceased PSB employee used to get a maximum of Rs 9284 per month as a family pension said Department of Financial Services Secretary Debasish Panda The cap has been completely removed and a uniform slab of 30 per cent at the last-drawn salary will be entitled as family pension Panda told reporters here admitting that the earlier levels were paltry This would result in the family pensions rise to as high as Rs 30000-Rs 35000 a month Panda said Similarly the ministry has also decided to increase the employers contribution in New Pension Scheme NPS to 14 per cent of the salary from the current 10 per cent he said Earlier Finance Minister Nirmala Sitharaman expressed her satisfaction at public sector banks PSBs performance in the past few years and appreciated that many of them have come out of the RBIs prompt corrective action framework Panda said a dozen PSBs have become leaner and started delivering profits which have upped the investor confidence in them and made them self-dependent for capital raising He said that since last year the banks have collectively raised over Rs 69000 crore including Rs 10000 crore in equity and are in the process of raising another Rs 12000 crore at present On the governments plans to reduce stakes in insurers Sitharaman said the government will go down to having minimum holdings in such companies She also asked the employees not to fear anything saying the government is sensitive about their concerns When asked about the reports of government mulling insurance bonds as an alternative to bank guarantees Sitharaman said it was just a suggestion that had come from the industry Meanwhile giving the progress on the National Asset Reconstruction Company Panda said the entity has been registered and the Indian Banks Association has already approached the Reserve Bank of India RBI for licence We expect that licence to come in soon Assets to be transferred have already been identified process of getting the inter-creditor agreement is also in the works CEO has been appointed and staff has been put in place he said Panda added that the government guarantee is not a concern but remains under consideration PTI AA HRS hrs
