Mumbai Sep 28 PTI The Bombay High Court on Tuesday refused bail to Yes Bank founder Rana Kapoors wife Bindu and daughters Roshini and Radha Kapoor in a case involving home finance firm DHFL noting that the offenses they were accused of made a serious dent to the countrys financial health Justice Bharati Dangre also rejected the bail plea of Rajiv Anand group president and business head of Yes Bank who is a co-accused in the case it is apparent that all the applicants are alleged to have indulged in the commission of offenses which have resulted in serious dent to the financial health of the State as well as defrauding of the public at large the court said in the order Such offenses are occurring in plenty and have resulted in stultifying the overall growth of the nation and also have caused tremendous impairment to the economy of the nation These crimes are more heinous in nature as they destroy the economic fabric and financial edifice of the State it added Such crimes have the tendency to degrade the publics faith in the law and order situation as it is tantamount to a serious blow to its economic and financial condition the high court added Bindu Kapoor and her daughters approached the high court last week challenging a special CBI courts order of September 18 refusing them bail The CBI court had noted that on the face of it a loss of Rs 4000 crore was caused to Yes Bank through the alleged illegal acts After the three women appeared before the lower court in response to summons they were remanded in 14-day judicial custody The CBI court also said they did not deserve any sympathy for being women It also rejected Anands bail plea and remanded him in judicial custody Justice Dangre in the order on Tuesday noted that in the cases where offenses are grave heinous barbaric seditious or aimed at damaging the financial health of the state a court is expected to take these circumstances into consideration while deciding bail applications Arrest can become necessary if the offense is of grave nature and there is likelihood of the offender absconding or fleeing away from justice the high court order said The bail applications of Bindu Kapoor and her daughter took objection to the CBI courts observation that the accusations on the face of it showed their complicity in receiving loans as a quid-pro-quo for favours shown by Yes Bank to DHFL They were on bail when the case was being probed and had cooperated with the Central probe agency the applications said Justice Dangre however refused to accept this argument The situation during the investigation stage need not continue throughout and in particular when the offense as per the charge sheet is a grave economic offense she said The Central Bureau of Investigation had said there was nothing wrong with the special courts order denying them bail and it was merely securing the presence of the accused for the trial According to the CBI Rana Kapoor who is presently in jail in connection with a related case being probed by the Enforcement Directorate entered into a criminal conspiracy with DHFLs Kapil Wadhawan Between April and June 2018 Yes Bank invested Rs 3700 crore in short-term debentures of DHFL and in return DHFL allegedly paid a kickback of Rs 900 crore to Kapoor in the form of loans to DoIT Urban Ventures a firm controlled by Kapoors wife and daughters the CBI alleged PTI SP GK KRK KRK KRK

Guwahati Aug 24 PTI Inching towards fulfilling a poll promise the Assam government on Tuesday signed an agreement with microfinance companies for a Rs 12000-crore loan waiver scheme which will benefit several lakhs of women borrowers The Finance Department of the Assam government signed a Memorandum of Understanding with Micro Finance Institutions MFIs to implement the Assam Micro Finance Incentive and Relief Scheme AMFIRS 2021 an official release said Altogether 38 MFIs and banks signed the MoU with the state government which will remain in force till March 31 2023 it added There were 14 lakh microfinance borrowers in the state till June this year and the new scheme will involve Rs 12000 crore credit portfolio out of which the state government will be required to expend around Rs 7200 crore said Chief Minister Himanta Biswa Sarma at the MoU signing function The scheme was devised with an objective to balance long-term view of ensuring continuity of micro finance for supporting economic activities of low income and poor households and providing relief to eligible customers for tiding over current stress in the microfinance sector due to various operational reasons he added Sarma said the scheme emphasizes responsible lending by financial institutions through compliance of RBI regulations and industry guidelines in letter and spirit while promoting responsible borrowing and timely repayment culture among customers While presenting the state Budget for 2021-22 Assam Finance Minister Ajanta Neog had said almost 26 lakh borrowers took loans worth Rs 12500 crore from various MFIs and the bulk of this portfolio is in rural areas With the micro-finance lenders following the mandatory Fair Practices Code an amount of more than Rs 4000 crore will start accruing to the borrowers from the lenders directly and will benefit lakhs of such borrowers almost immediately she had said Talking about the clauses in the MoU Sarma said that relief shall be extended to all borrowers for loans from up to three lenders and for loan amount of up to Rs 125 lakh only Under the scheme borrowers who have been repaying regularly with Zero Days Past Due will be provided one-time incentive to the extent of their outstanding balance subject to a cap of Rs 25000 Similarly borrowers whose payments are overdue that is the accounts which are overdue but not NPA the state government will pay the overdue amount All such borrowers will be encouraged to make timely installment payments so that their accounts remain standard and credit culture is reinforced he added The chief minister said the government after observing such borrowers for a time period as may be decided with mutual consultations on a case to case basis will make one-time incentive payment of Rs 25000 or equal to the outstanding balance whichever is lower Further borrowers who are stressed destitute and whose accounts have become NPA will need to apply through a format verified and certified by the lender Government will consider providing partial relief or full relief based on detailed evaluation he added Sarma also said that many people in the state are stressed by private money lenders and that is why the state government has decided to promote borrowing through MFI and banks that carry out their operations strictly adhering to RBI guidelines The prominent MFIs and banks that signed the MoU include Microfinance Institutions Network North East Small Finance Bank Association of Small Finance Bank of India Nightingale Finvest Grameen Development and Finance North East Micro Finance Association Bandhan Bank Arohan Financial Services HDFC Bank Fusion Microfinance LT Financial Services and Asirvad Microfinance Sarma during the Assembly election campaign in March-April this year had announced that all the MFI loans of women would be waived if the BJP-led coalition retained power but after assuming office he said that the promise was a political statement but not a government promise The opposition parties including Congress AIUDF Raijor Dal CPIM Assam Jatiya Parishad and BPF have attacked the government for its U-turn in waiving off the loans as promised by the BJP and said the saffron party has cheated the people PTI TR RG RG
