Mumbai Oct 30 PTI A special NDPS court here on Saturday once again denied bail to Siddharth Pithani the flatmate of Sushant Singh Rajput in a drugs case linked to the Bollywood actors death in June 2020 Pithani was arrested by the Narcotics Control Bureau NCB on May 28 this year from Hyderabad and he is currently in judicial custody He was booked under section 27 A financing illicit traffic and harboring offenders of the Narcotic Drugs and Psychotropic Substances NDPS Act among other charges His latest bail plea was rejected by Special Judge D B Mane Earlier his regular bail plea was rejected in August though the court had given him interim relief to attend his marriage On Friday Pithani moved another bail application saying section 27A of the NDPS Act was wrongly applied and prayed for bail saying only a small quantity of drugs was seized Section 27A pertains to punishment for financing illicit traffic and harbouring offenders Special Public Prosecutor Advait Sethna appearing for NCB argued that all these grounds raised by Pithani were considered earlier Sethna argued that Pithani had not challenged the previous bail order in the High Court As section 27A is invoked and the court found substance in NCBs arguments the anti-drug agency got 180 days to file a chargesheet which is also not over Hence his bail application be rejected he said The NCB has been probing the drugs angle post the death of Rajput whose body was found hanging in his flat based on some WhatsApp chats about the alleged supply of drugs to some actors in Bollywood Following the actors death the NCB began a probe into alleged drug links in the film industry based on WhatsApp chats and several people were arrested under the NDPS Act in this connection most of who are out on bail currently PTI AVI NSK NSK

New Delhi Oct 24 PTI The Social Justice and Empowerment Ministry has recommended decriminalising possession of small quantities of drugs for personal consumption in its review of the Narcotic Drugs and Psychotropic Substances NDPS Act submitted to the Revenue Department Currently there is no provision for relief or exemption under the NDPS Act and it only gives addicts immunity from prosecution and imprisonment if they volunteer for rehabilitation In its recommendations shared with the Department of Revenue last week the ministry suggested decriminalising possession of small quantities of drugs for personal consumption officials said The ministry suggested that the compulsory treatment in government centres must be given to those caught with small quantities for personal consumption instead of a jail term an official said Possession of drugs is a criminal offence in India and Section 27 of the NDPS Act prescribes imprisonment of up to a year or a fine of up to Rs 20000 or both for consumption of any narcotic drug or psychotropic substance Actor Shah Rukh Khans son Aryan Khan has been arrested under this section PTI UZM SMN SMN

Mumbai Oct 22 PTI Chats messages and videos recovered from actor Armaan Kolhis mobile phone indicate on the face of it that he was involved in illicit drug trafficking a special court has said while rejecting his bail application The special judge for cases under Narcotic Drugs and Psychotropic Substances NDPS Act A A Jogelkar rejected the actors bail plea on October 14 The detailed order became available on Friday Kohli was arrested in the last week of August As per the Narcotics Control Bureau NCB 12 grams of MD was recovered from Kohlis house while bigger quantities of drugs were recovered from the co-accused in the case The court held that after examining the material obtained during the probe prima-facie it seemed that Kohli was well-connected with the co-accused pertaining to illicit trafficking of drugs Special prosecutor Advait Sethna had submitted chatsmessages between Kohli and the co-accused along with their bank statements before the court The judge noted that bank transactions corroborated alleged transactions revealed from the chats Kohli failed to explain the purpose of contraband recovered from his house and the financial transactions the court said Contents in the chats and videos also propagate for the indulgence of the applicant in illicit trafficking prima-facie and therefore the prosecution seems to have invoked section 27A of the NDPS Act against the applicantaccused the judge said Section 27 A is about punishment for financing illicit traffic and harbouring offenders Investigation was at a nascent stage the court observed while rejecting the bail plea PTI AVI KRK KRK KRK

New Delhi Sep 24 PTI The Delhi High Court Friday stayed an order of the National Consumer Disputes Redressal Commission NCDRC sentencing Supertechs MD Mohit Arora to 3-year imprisonment and issuing arrest warrant against him for non-compliance of an order in a case by a home buyerJustice Amit Bansal directed the realty firm to deposit Rs 50 lakh out of the outstanding Rs 175 crore in the home buyers account within a week to show its bona fide to the courtThe NCDRC order to the extent that the companys MD is sentenced to 3-year imprisonment shall remain stayed till the next date of hearing - October 4The court also directed both the company and the home buyer to place on record the statement of amount due as per the NCDRC orderThe high court was hearing Supertechs plea challenging the September 20 order by which Arora was given 3-year jail and the arrest warrant was issued against him for non-compliance with NCDRC directionsThe NCDRC case pertained to the home buyers complaint for delay in giving possession of a villa in one of the companys project in Yamuna Expressway Industrial Development Area which was allotted for over Rs 1 croreSenior advocate Sandeep Sethi representing Supertech argued that the NCDRC order was beyond the provisions of section 27 of the Consumer Protection Act and there was no provision it which casts vicarious liability on the MD to make him liable in criminal or civil matter in case of default by the companyThe MD was sentenced without even conducting a trial he said added so the man goes to jail if the company does not comply with the order in seven daysThe plea was opposed by home buyer Kanwal Batras counsel who said the company was in repeated default of the NCDRC order and has gone back on its undertaking to the forumAdvocate Shailesh Madiyal appearing for Batra said everytime the company gives an undertaking to NCDRC and then fails to turn up the next time and warrants have to be issuedDuring the hearing Supertechs counsel offered to pay Rs 40 lakh to the home buyer within a week to show bona fide however the complainants counsel said it was too smallThe court then directed the company to deposit Rs 50 lakh within a week after which it will again hear the matter and added that substantial money has to come backThe high court was earlier informed that the arrest warrant was issued on September 20 by the NCDRC which had on September 13 rejected Supertechs plea for fixing 12-month instalments for payment of the decretal amountIn April 2019 the NCDRC had ordered the company to either give possession of the villa within six months along with compensation and costs or refund the entire amount received by it along with compensationOn July 20 the MD had assured the NCDRC that the order would be complied with within 60 daysHowever on September 20 NCDRC noted that in spite of the commitment the order was yet to be implemented and opined that the company was evading the implementation of the decreeIt had thus issued an arrest warrant against the MD and sentenced him to three years imprisonment subject to the implementation of the order within a weekIn view of non-compliance of the direction and dishonouring his own commitment we sentence the MD of the Judgement Debtor company as per powers under Section 27 of the Consumer Protection Act 1986 for three years imprisonment and issue warrants of arrest against the managing director of the Judgment Debtor company The warrants shall not be executed if the Judgment Debtor deposits the decretal amount before this Commission within one week it had said PTI SKV SA
