Mumbai Oct 29 PTI The Bombay High Court on Friday refused to quash the summonses issued by the Enforcement Directorate ED to former Maharashtra home minister Anil Deshmukh in a case of alleged money laundering and corruption and noted he has failed to prove probe agencies had been acting in a malafide manner against himA bench of Justices Nitin Jamdar and SV Kotwal also rejected Deshmukhs prayer to restrain the ED and the Central Bureau of Investigation CBI from taking any coercive action against himThe bench said the Nationalist Congress Party NCP leader who resigned from the cabinet in April this year had failed to prove to the court that in probing him and in calling him for questioning the two central agencies had been acting in a malafide mannerIt said if Deshmukh apprehended his arrest by either of the agencies he had the right that was available to any other citizen or litigant to approach the appropriate court to seek protectionThe court however directed the ED to permit Deshmukhs lawyer to remain present within visible distance but not audible distance at the central agencys office during the former ministers questioningThe ED had begun a probe against Deshmukh and others and summoned him for questioning after the CBI filed an FIR against the 71-year-old politician on April 21 this year on charges of corruption and misuse of official positionThe CBI FIR was registered following a preliminary inquiry into the allegations of corruption and misconduct made against Deshmukh by former Mumbai police commissioner Param Bir SinghThe EDs money laundering probe against Deshmukh also stems from the FIRDeshmukh approached the HC earlier this year seeking among other things that the two agencies be restrained from taking any coercive action against him and that the several summonses issued to him by the ED asking him to appear before it in person for questioning be quashedHis counsel senior advocate Vikram Chaudhri told the bench Deshmukh was a victim of political vendetta and questioned the timing of the summonses issued by the EDThe advocate also argued that both ED and the CBI had been acting upon allegations made by persons who themselves were accused of heinous offencesAdditional Solicitor Generals Aman Lekhi and Anil Singh appeared in the HC for the ED and the CBI respectively and opposed Deshmukhs pleaThey denied the allegations of any prejudice or malafideLekhi told the court Deshmukh was no longer a minister and did not enjoy any special privileges He said the ED had issued at least five summonses to Deshmukh between June and July this year but the former minister had failed to appear before the agency so farLekhi said that like any other citizen summoned by the ED Deshmukh too was bound by law to make an appearanceThe HC agreed with the submissions made by the two agenciesIt said Deshmukh had failed to clarify what exactly was the illegality or malafide behind the summonses In fact it was Deshmukh who was in breach of the law and who had committed an illegality by not responding to the summonses the bench saidThe Applicants challenge to the summonses is primarily founded on the grounds of abuse of power and malafides of the Respondent Directorate the HC said adding Nothing is shown to us as to how the ongoing investigation is either beyond the jurisdiction of ED or illegal The court further said Deshmukh had merely made vague allegations against unnamed persons and their involvement in heinous offences Such arguments were devoid of merit and did not call for the high court to interfere with the ED or CBIs investigationsThere is a statutory right of the police to investigate the cognizable crime without requiring any authority from the judicial authority the HC observedThus save in exceptional cases where non-interference would result in a miscarriage of justice the court and the judicial process should not interfere at the investigation stage of offences it saidThe court noted that in the present case Deshmukh had failed to show how the summonses were illegal or how the ED was overreaching its jurisdictionThe details of these allegations have not been elaborated in the petition The pleadings are bereft of any particulars This court is called upon to engage in guess work to presume malafides against the Directorate the HC saidThe court also rejected Deshmukhs prayer to permit him to submit documents electronically and to respond to the summonses via video-conferencing and not in-personThe septuagenarian politician had said he was a senior citizen and considering his co-morbidities he was susceptible to contracting COVID-19 if made to appear before the ED physicallyThe HC however said The activity of money laundering is often very complex masked under various layers and the methods of investigation resultantly also are complex Furthermore since we have not found that issuance of summonses to the Applicant is vitiated by malafides or that the Officers of the Directorate ED are proceeding beyond their duty there is no reason why we should dictate a different course of investigation in this case Thus the prayer to direct Respondent No2 ED to permit the Applicant to appear through an authorised representative or through any electronic mode and not to compel the presence of the Applicant in person is rejected and it is left to the discretion of the
