New Delhi Nov 24 PTI The Supreme Court Wednesday agreed to hear a plea of lawyers seeking resumption of full-fledged physical hearings in the apex court saying it is up to the Supreme Court Bar Association SCBA and Bar Council of India BCI to take a call on the issueA bench of Justices L N Rao B R Gavai and B V Nagarathna listed the intervention application along with other pending plea filed by another set of lawyers seeking continuance of virtual hearing claiming it to be a fundamental rightAdvocate Smarhar Singh appearing for the lawyers said they are opposing the plea for virtual hearingSingh who mentioned the matter said that they are opposing the plea as lawyers with 10-15 years of practice feel more comfortable arguing in physical modeThe bench however said There are some lawyers who want virtual hearing and some want physical hearing You must sort it out The Courts are ready for physical hearing Ultimately it is the SCBA and BCI which will have to take a call Singh said that speaking for himself he has 10-15 years of experience and he feels more comfortable arguing in physical mode as there are no technical glitches and advocates can argue their cases looking at the judgesThe bench said it agreed with Singhs view as courts also like when advocates make arguments before it and directed the listing of the matter along with other pending mattersOver 100 lawyers who mostly practice in the top court have sought its intervention for the resumption of complete physical hearing like it was done before the onset of COVID-19 pandemic in March last yearThe lawyers said that traditionally the administration of justice required hearing of the case in open court proceedings and even provisions of CrPC require trial of all civil and criminal cases in open courtThey said that despite efforts made by the top court to return to its normal functioning by resumption of physical hearing some motivated petitions are being filed to stall those attempts PTI MNL SA

New Delhi Sep 27 PTI A day after CJI N V Ramana exhorted women lawyers to strongly seek 50 per cent reservation in higher judiciary the Supreme Court Bar Association SCBA on Monday hailed the statement and urged him to appoint them as judges being the head of the collegium The Chief Justice of India speaking at the event organised by the Women Advocates of Supreme Court here to felicitate him and the nine new apex court judges on Sunday exhorted women lawyers to strongly raise demand for 50 per cent reservation in the judiciary and assured them of his total support I dont want you to cry but with anger you have to shout and demand that we need 50 per cent reservation Justice Ramana said SCBA President and senior advocate Vikas Singh in a press statement said I have seen the comments attributed to the Honble CJI exhorting women lawyers to ask for 50 per cent reservation in the higher judiciary I am extremely happy that the CJI took out time to meet the lady lawyers At the same time I feel as the elected body the CJI should meet the Executive Committee of the SCBA more frequently as through several letters we have been requesting for a meeting which has not been granted to us Moreover the CJI being the head of the institution and the appointments being done by the collegium system he can easily provide for more and more representation of women lawyers without any representation in this regard The statement issued on Monday said the SCBA has always been urging for a larger representation of women in higher judiciary and the search committee of the bar body has recommended names of Supreme Court lawyers for elevation to high courts and the list contained the names of 13 lady lawyers Singh said that the list of suitable candidates for being considered for elevation to the high courts was pending with the CJI With this statement of the Honble CJI we are sure that steps if not already taken would be taken immediately and as a first step the recommended names would be sent for consideration especially the names of lady lawyers the SCBA President said The statement raised the allegation that several women lawyers practising in the top court were neither informed nor invited to the felicitation function and moreover they are alleging that there is no such lady lawyers association in existence The SCBA in its earlier press statement had sought an audience with the CJI for its Executive Committee members to discuss issues such as elevation of apex court lawyers as high court judges their designation as seniors physical hearing and allotment of chambers in the premises here PTI SJK SA

New Delhi Sep 23 PTI The Supreme Court Thursday asked bar body SCBA to encourage lawyers to attend hearings physically as it is willing to consider changing the standard operating procedure SOP framed to govern court proceedings due to COVID-19 We have lawyers coming in trickles We have few lawyers coming in everyday why cant others come a bench headed by Chief Justice N V Ramana said when the Supreme Court Bar Association SCBA President and senior lawyer Vikas Singh raised the issue of resumption of physical hearing by terming the fresh SOP was a non-starter You Singh encourage your members of the Bar to try to come physically Let them come We are trying we will consider the SOP and everything No issues said the bench which also comprised justices L Nageswara Rao and Surya Kant Do not give any option to the lawyers Please open the courts said lawyer Shivaji Jadhav who is also the President of the Supreme Court Advocates-on-record Association SCAORA The apex court which had adopted virtual mode of hearing in March last year recently resumed hybrid form giving option to lawyer to appear physically or virtually to argue cases from September 1 The observations were made when the bench was hearing the suo motu case related to extension of limitation period for filing court cases due to COVID Earlier Singh in his letter to the CJI had said that system of issuing special passes for the high security area in the apex court premises be dispensed with in the SOP issued by the Secretary-General on August 28 this year Entry to the high-security area should be permitted by the use of a proximity card and the waiting areas would be the libraries and the lounges where lawyers will wait on their own after observing COVID protocol he had said PTI SJK SA
