Sushant Singh Rajput’s family lawyer Vikas Singh has openly demanded for the arrest of Rhea Chakraborty and other prime accused in the actor’s death case.
According to Singh, under the provisions of criminal law, the discretion to arrest the suspects named in the first investigation report (FIR) lies with the police.
He said that previously, the Patna police team investigating in Mumbai was more cautious about making arrests. He also added that the Patna Superintendent of Police was quarantined in Mumbai, making it impossible for him to probe the case any further.
All this while, when the fight for jurisdiction was going on in the Supreme Court, no arrests were made, due to lack of clarity on the course of action. Further, Singh revealed that senior counsel Mukul Rohatgi also made an oral statement in court saying that no action should be taken in haste.
Now with full clearance from the apex court, Singh stressed that Rhea Chakraborty and all the others named in the FIR should be detained for custodial interrogation. He also said that Sushant’s friend, Siddharth Pithani, though not a named accused, should also be taken in by the CBI following his seeming loyalty towards Chakraborty.
Responding to the question that arrests in abetment to suicide cases are not common, Singh stressed that a FIR suffices to apprehend the accused for questioning.
