Aryan Khan was released from jail in a drug case after the Bombay High Court granted him bail. He stepped out of jail on October 30 and he was put in jail on October 3 after the NCB officials detained him on a Mumbai to Goa bound cruise. In an order released today by the Bombay High Court, it is said that is no evidence of a conspiracy between Aryan Khan, Arbaaz Merchant, and Munmun Dhamecha to commit drug-related offences.

The Court said that nothing objectionable was found in WhatsApp conversations between them. The court order reads as there is hardly any positive evidence on record to convince this Court that all the accused persons with common intention agreed to commit unlawful acts. Merely because Aryan Khan, Arbaaz Merchant, and Munmun Dhamecha were travelling in the same cruise, that by itself cannot be a foundation for the charge of conspiracy against them is what the court explained the justification behind the bail.

The High Court order also said that the Narcotics Control Bureau (NCB) cannot rely on the alleged confessional statements recorded by the investigating officer as they are not obligatory. Aryan Khan was not found in possession of any objectionable substance is not in dispute, the high court said in a 14-page order. It also stated that the number of drugs which was seized from the possession of Arbaaz and Munmun, if independently considered, is a small quantity, is not a disputed fact.

While the NCB had argued that a high degree of evidence is not required at the stage bail of the proceedings to establish the case of conspiracy, the HC said that it is required to be sensitive to the fact that there has to be the presence of basic material in the form of evidence so as to substantiate the case of conspiracy. Following the order of the HC granting bail to the three, so far 12 others have also been released on bail by the special court. The NCB has arrested 20 accused in all till now.
